La regulación del fenómeno sucesorio es sin duda una de las grandes conquistas alcanzadas por la scientia iuris, debido a que define el destino de las relaciones jurídicas transmisibles de un ser humano al momento de su muerte. Cuando muere un autor de una obra protegida, la transmisión de sus derechos sigue las reglas generales del derecho de sucesiones. Sin embargo, dada la estructura bidimensional de los derechos de autor, que comprende derechos personales fundamentales y otros patrimoniales, surgen ciertas inquietudes sobre el rol de los herederos y el ejercicio efectivo de sus intereses, así como inconvenientes prácticos que pueden afectar intereses colectivos como el acceso efectivo al conocimiento y a la cultura. En el derecho romano, los negocios por causa de muerte, y en particular el testamento, acto jurídico complejo, ofrecen al causante la posibilidad de disponer a cabalidad de todos sus derechos. Esta experiencia jurídica, fundamental en la formación del ordenamiento colombiano, reivindica el valor de la capacidad dispositiva por causa de muerte, que frente al derecho de autor constituye una alternativa concreta para asignar debidamente los derechos que recaen sobre la obra, superando así problemas como la incertidumbre en torno a los derechos que de ella se desprenden, o su eventual orfandad.
La imagen personal involucra no solo la apariencia física, sino cualquier rasgo que permita individualizar a una persona de manera inequívoca. Su uso y divulgación no es una cuestión reciente, pues se conocen aproximaciones desde el Derecho romano que ligan la imagen personal principalmente al honor que permiten encontrar rasgos coincidentes con las concepciones actuales. En la legislación colombiana vigente se encuentra regulación relativa al derecho a la propia imagen en las normas de derecho de autor, marcario, protección de datos personales, Código de Policía y ahora en el proyecto de reforma del Código Civil; también la Corte Constitucional colombiana lo ha desarrollado como derecho fundamental autónomo. En otros países del mundo, su mayor desarrollo está ligado al régimen de protección de datos personales y de forma similar la imagen es considerada un dato personal biométrico de carácter sensible. Recientemente, con nuevas tecnologías como la Inteligencia Artificial (IA) y sus campos de aplicación, se observa su impacto en el derecho de imagen, surgiendo nuevas preguntas y retos que van a ocupar al Derecho.
