ZusammenfassungIm Bereich der Strafzumessungsforschung ist es erforderlich, die unterschiedlichen Sanktionsarten vergleichbar zu machen und auf einer einheitlichen Strafhärteskala abzubilden. Dieser Artikel gibt zunächst einen Überblick über die bisher erstellten Strafhärteskalen, die entweder ad hoc gesetzt, empirisch ermittelt oder logarithmisch skaliert wurden. In Deutschland gibt es bisher lediglich eine empirisch ermittelte Strafhärteskala, die zudem nur für Geldstrafen und Freiheitsstrafen bis zu zwei Jahren Gültigkeit für sich beanspruchen kann. Der Bereich hoher Freiheits- und Jugendstrafen ist empirisch nicht abgedeckt. Der hier vorgelegte empirische Skalierungsansatz soll einen Beitrag dazu leisten, diese Lücke zu schließen. Richterinnen und Richter an Landgerichten wurden zu ihrer Strafhärteeinschätzung befragt, und die gewonnenen Daten wurden mittels Magnitude-Skalierung skaliert. Die Studie ergab für alle vier untersuchten Sanktionsarten (Freiheitsstrafe mit und ohne Bewährung sowie Jugendstrafe mit und ohne Bewährung) Potenzfunktionen, mithilfe derer jeder ausgeurteilten Sanktion ein Härtewert zugewiesen werden kann.
