Producto a la emergencia sanitaria originada por la pandemia del Covid-19, el mundo laboral sufrió un fuerte impacto; en el Ecuador se adoptaron medidas emergentes para proteger a los trabajadores y menguar el impacto provocado por esta crisis; así como para contrarrestar la inoportuna aplicación del artículo 169 numeral 6 del Código del Trabajo. Durante el estado de excepción emitido mediante Decreto Ejecutivo 1017 del 16 de marzo de 2020. El objetivo del presente trabajo es analizar la inconstitucionalidad de la disposición interpretativa de dicho artículo como parte de las medidas de apoyo humanitario dictadas a favor de las garantías de la continuidad de la relación laboral en la emergencia sanitaria y los efectos de su inadecuada aplicación; para ello se realizó una investigación descriptiva fundamentada en los métodos exegético, hermenéutico e histórico-lógico. Se concluye que, la utilización abusiva e injustificada de la causal 6 del Art. 169, del Código del Trabajo afectó la fuerza laboral del país, pues las leyes y reglamentos del Ecuador eran entonces insuficientes para garantizar el principio de continuidad o estabilidad laboral, por razón de caso fortuito o fuerza mayor, lo que indica la violación del derecho al principio de estabilidad en el trabajo.
