According to article 2 of the Labour Code, the principal employer shall be jointly liable with the subcontractor for the obligations ensuing from Labour Code and from employment contracts of subcontractor's employees or from the collective agreement to which the subcontractor has been signatory. For social insurance premiums, joint liability is regulated in the Code No. 5510. However, although employer and wage are defined in tax laws, the principal employer is not defined. In addition, no obligation has been established on the principal employer regarding the receivables of the subcontractor workers. In accordance with the principle of legality, the principal employer is not the employer of the subcontractor's workers in terms of tax law. Because it is out of the question to recruit and operate by giving orders and instructions. Otherwise, there will be collusion. While the principal employer is jointly and severally liable for the wages and premiums of the subcontractor workers, it will not be able to stoppage income tax due to the lack of clear regulation. It is the sub-employer, who is the “employer”, who is responsible for withholding income tax from wages. Until this gap is filled by the legislator, the nature of the payment made by the principal employer to the subcontractor worker will not be counted as wage within the meaning of the Income Tax Code.

Bu nedenle, ebeveyn işsizliğini önlemek için, iş-yaşam dengesini sağlayan düzenlemeler, çocuklarına bakmak için evde kalmanın önüne geçebilir. Bu konuda hükümet, sendikalar ve işverenlerin hepsi sorumludur. Bu problemin çözümünde esnek çalışma konusunda farklı bakış açıları aramalı, aile dostu politikaları toplum düzeyinde gözden geçirmeli ve bu konuda yeni düzenlemeler yapmalıyız. Bu çalışma, işin ve çalışanın verimliliğini sağlayan işyaşam dengesi ve iş-yaşam kalitesi kavramları hakkında bilgi vermektedir. Türk iş hukuku mevzuatında yer alan analık izni, babalık izni, ebeveyn izni konuları çalışmada incelenmektedir. Bunu, politika tasarlayanlara uygulama önerileri izlemektedir.
20.01.2011 tarihli C-463/09 sayılı Avrupa Birliği Adalet Divanı kararı çalışma kapsamında incelenmektedir. Karara konu olayda uyuşmazlık, devrin sonuçlarına ilişkin değil, bir devrin söz konusu olup olmadığına ilişkindir. Bu nedenle çalışmada da işyeri devrinin sonuçları üzerinde durulmamaktadır. Yönerge kapsamında "işyerinin devri" kavramı kısaca incelenmekte, karara konu olayda mevcut olan salt faaliyet devrinin AB hukuku, İngiliz hukuku ve Türk hukukunda işyeri devri kapsamına girip girmediği belirtilmektedir. Hukukumuzda işin devri, şartlar da sağlandığında asıl işveren alt işveren ilişkisi içinde mülahaza edilmekte ve işçiler işyeri devri düzenlemelerinden daha sıkı bir yaklaşım içinde alt işverenlik düzenlemeleri ile korunmaktadır. Türk hukukunda salt faaliyet devri alt işverenlik ilişkisine vücut verebilen bir konudur. Bu nedenle çalışmada Türk hukukunda işyerinin bir bölümünün devri ile asıl işveren-alt işveren ilişkisinin bağdaşıp bağdaşmayacağına dair olan tartışmalara yer verilmektedir. Bu konudaki görüşümüz izah edilmektedir.
