In this paper, we analyse the most important documents establishing the criteria for the treatment and exclusion of COVID-19 patients, especially in regard to the giving of respiratory support, in Italy and Spain. These documents reflect a tension that stems from limited healthcare resources which are insufficient to save lives that, under normal conditions, could have been saved, or at least could have received the best possible treatment. First, we analyse the healthcare systems of these two countries before the spread of the virus, both of which have seen decreases in the number of intensive care beds and have been marked by financial cuts during the last ten years. It is a fact that a greater number of people, especially those over 70 years of age, have been left without respiratory support treatment, and therefore, there have been a greater number of deaths. It is also a fact that there has been a higher infection rate among healthcare professionals due to the delay in the management of protective measures and the inability to provide adequate care for those in nursing homes, as recognised by WHO. In the context of this health emergency, healthcare professionals have suffered a real ‘moral distress’ because, knowing first-hand the causes of the limitation of resources, they have had to put triage protocols into practice. Finally, we set forth a series of concrete ethical proposals with which to face the successive waves of COVID-19 infection, as well as other future pandemics.
Artykuł podejmuje zagadnienie ujęć teologii małżeństwa w adhortacjach Familiaris consortio oraz Amoris laetitia z punktu widzenia duszpasterstwa. Podjęty problem rozwiązywany jest przede wszystkim za pomocą metody analizy porównawczej tekstów źródłowych. W pierwszej części artykułu przedstawiono refleksję na temat kontynuacji oraz rozwoju nauczania w Kościele. Ciągłość tego rozwoju przypomina wzrost organizmu żywego, który poprzez różne etapy dochodzi do form coraz dojrzalszych. W podobny sposób adhortacja Amoris laetitia, wychodząc od nauczania zawartego w Familiaris consortio, rozwija je zgodnie ze specyficznym, nowym podejściem papieża Franciszka, przestawionym w adhortacji Evangelii Gaudium. Druga część artykułu pokazuje, że Amoris laetitia wpisuje się w tradycję nauczania Kościoła na temat małżeństwa i rodziny, współbrzmiąc z takimi dokumentami, jak: soborowa konstytucja Gaudium et spes, encyklika Humanae vitae Pawła VI, list do rodzin Gratissimam sane Jana Pawła II, a przede wszystkim adhortacja Familiaris consortio. Obydwa analizowane w artykule dokumenty postulują koncentrację na konkretnych życiowych realiach oraz przedstawiają wspólny ideał małżeństwa chrześcijańskiego, jego sakramentalności i otwartości na życie. Trzecia część artykułu, koncentrując się szczególnie na podejściu do tzw. sytuacji „nieregularnych”, pokazuje, w jaki sposób Amoris laetitia jest rozwinięciem nauczania Familiaris consortio. Rozwój doktryny przedstawiono w szerszym kontekście, prezentując nauczanie Franciszka jako kolejny etap na drodze zapoczątkowanej przez jego poprzedników, uwzględniającej „prawo stopniowości”, rozeznanie osobiste i duszpasterskie oraz integrację wiernych w sytuacjach niedoskonałych. Przeprowadzone analizy wykazały, że adhortacje Familiaris consortio oraz Amoris laetitia stanowią dwa istotne kroki na drodze Kościoła posoborowego, wyznaczonej przez konstytucję Gaudium et spes, oraz że pomiędzy dokumentami widać wyraźnie ciągłość oraz rozwój nauczania.
L’articolo affronta il tema del trapianto di gonadi a partire dai primi tentativi tardo ottocenteschi sino agli sviluppi odierni, tenendo conto sia dell’aspetto biomedico sia di quello etico. Si prendono in esame due possibili situazioni, il trapianto finalizzato a ripristinare una ormonogenesi deficitaria e il trapianto finalizzato a ripristinare la fertilità, cercando sempre di riportare i problemi alla loro radice antropologica. Il primo tipo di trapianto, lecito in linea di principio, pone tuttavia delicati problemi riguardo alle possibili ripercussioni sulla personalità del trapiantato; il secondo non solo si configura come una variante sofisticata della fecondazione eterologa, ma determina in aggiunta una violazione dello spazio personale attraverso l’inserzione di informazione genetica estranea trasmissibile alla prole. Nella stessa prospettiva si esaminano infine anche le discusse questioni del trapianto di tessuti gonadici provenienti da feti abortiti e da cadaveri, mostrandone l’impraticabilità psicologica ed etica.
I progressi delle biotecnologie dischiudono scenari nuovi con i quali deve confrontarsi la riflessione bioetica. La produzione di ibridi, chimere e organismi transgenici usando gameti o materiale genetico umano è tra le questioni più scottanti e attuali. L’articolo ribadisce, secondo l’insegnamento di Donum Vitae, l’illiceità delle diverse forme di ibridi e chimere, mentre ritiene non illecita in linea di principio la transgenesi con geni di provenienza umana anche in mammiferi superiori, purché siano rispettate alcune condizioni prudenziali. In questa prospettiva di cauta apertura alla transgenesi si muoveva il documento sugli Xenotrapianti della Pontificia Accademia per la Vita. Le posizioni dell’Accademia sono state criticate da un gruppo di eticisti australiani le cui argomentazioni vengono esaminate e respinte nel presente articolo. ---------- The progress of the biotechnologies disclose new sceneries to which bioethics reflection has to compare. The production of hybrids, chimeras and transgenic organisms using gametes or human genetic material is among the most burning and actual matters. The article insists, according to the teaching of Donum Vitae, on the unlawfulness of the different forms of hybrids and chimeras, while it consider not illegitimate in principle the transgenesis with genes of human origin also in superior mammals, provided that some prudential conditions are respected. The document on the Xenotransplants of the Pontifical Academy for Life shares this perspective of cautious opening to the transgenesis. The positions of the Academy are been criticized by a group of Australian ethicists whose arguments are examined and rejected in the present article.
Le donne con infertilità da fattore uterino (FUI) dovuto a motivi congeniti (es. sindrome di Rokitansky) o a isterectomia non hanno alcuna possibilità di realizzare il loro desiderio di maternità se non ricorrendo all’adozione o alla maternità surrogata che, però, è proibita in molti paesi. Il trapianto di utero, attualmente in studio, potrebbe rappresentare una alternativa per le donne che desiderano fare esperienza della gravidanza. Dopo decenni di ricerche animali, in Svezia si è avuto la prima nascita dopo trapianto di utero e fecondazione in vitro e questo prova che il trapianto di utero potrebbe essere un trattamento per la FUI. In linea di principio il trapianto è accettabile, ma ci sono molti problemi etici che devono essere considerati nel contesto della sperimentazione e di una eventuale introduzione nella pratica clinica. ---------- Women with uterine factor infertility (UFI) stemming from congenital causes (e.g. Rokitansky syndrome) or from hysterectomy are not able to fulfill their longing for motherhood except resorting to adoption or surrogacy, a practice that is forbidden in many countries. The uterine transplantation is currently under study as an alternative option for women who desire experience pregnancy. After decades of animal researches, in Sweden the first livebirth after uterine transplantation and IVF has been reported and this report is a proof for uterine transplantation as a treatment for UFI. Uterine transplantation is, as principle, morally acceptable, but many ethical issues must be considered in the context of clinical trials and eventually of standard practice.
