El escenario histórico novedoso denota la necesidad de elaborar teorías jurídicas aptas para proteger al ciudadano y a su ecosistema y que adapten sus piezas al modelo de Estado constitucional, que refleja la positivización del Derecho natural plasmada en el reconocimiento de los derechos humanos. Asimismo, sostenemos que una teoría adecuada debe analizar a la complejidad de la vida ya que el Derecho es un objeto cultural; por consiguiente, empleamos la metodología trialista como una táctica para la integración de las dimensiones: sociológica, normológica y dikelógica o axiológica del mundo jurídico. A tal fin, utilizamos las categorías estratégicas –nos ofrecen una visión dinámica- con un enfoque teórico que se nutre de otros valiosos aportes iusfilosóficos e interdisciplinarios dirigidos a cualesquiera de esas dimensiones; de ese modo, proporcionamos ideas que pueden resultar útiles para el desarrollo de otras corrientes iusfilosóficas ya que ellas evolucionan en base a su comunicación recíproca.
El trabajo presente tiene como objeto destacar la insuficiencia de la relación de causalidad como presupuesto de responsabilidad civil por los daños producidos por la robótica y sistemas autónomos (RSA) en la revolución tecnológica basada en BIG data. Para ello, analizamos las categorías de la responsabilidad civil conforme la normativa del derecho privado patrimonial argentino. El núcleo argumentativo de esa idea radica en que los RSA funcionan por medio de correlaciones que operan como un límite para la previsibilidad de los diseñadores, fabricantes, propietarios y operadores, que constituye un elemento esencial para calificar a la causalidad como presupuesto del derecho de la responsabilidad civil. Proponemos la vigencia de un seguro obligatorio por los daños previsibles causados por los RSA y la creación de un fondo de garantía para la reparación de los perjuicios imprevisibles causados por los RSA.
Es una contribución al progreso del Derecho de la Responsabilidad Civil en esta era digital a través del desarrollo de la función de la prevención de los daños causados por la robótica y los sistemas autónomos (RSA). Un análisis detallado de su funcionamiento —con el auxilio del enfoque interdisciplinario— nos posibilita disminuir la producción previsible de lesiones. Sin embargo, la función precautoria y diversas medidas ex ante —no están contenidas en esa función preventiva— resultan necesarias para disminuir el margen de riesgo de causación de daños provocados por los RSA en virtud de la imprevisibilidad en su accionar en algunos casos. Por ello, la determinación de la función preventiva se convierte en una cuestión esencial para: la comprensión de los desarrollos jurídicos contemporáneos y el progreso del Derecho de la Responsabilidad civil reconociendo la complejidad fáctica de la era digital y los diversos valores en juego que requieren una tutela efectiva de los usuarios alentando el desarrollo adecuado de la innovación tecnológica.
En este artículo mostramos la influencia de las herramientas tecnológicas –basadas en IA, aprendizaje automático y big data– en el mundo del trabajo que conllevan ventajas y riesgos para el trabajador. Entre estos últimos, destacamos el peligro que corre en su ecosistema de trabajo de: vigilancia ilegítima, manipulación que daña su salud y discriminación. Después de un breve recorrido por el Derecho laboral desde su fundación hasta hoy, analizamos las normas legales: europeas, españolas, norteamericanas y argentinas que cubren algunas de las lagunas normativas generadas en este novedoso universo fáctico. Asimismo, destacamos la necesidad imperiosa de su sistematización –en un marco de constitucionalización de las ramas jurídicas– cuyo propósito es proteger al trabajador respetando su: privacidad, salud, libertad, igualdad y dignidad como respuesta al exponencial avance digital en esta sociedad de la transparencia. Por otro lado, nos referimos a los tópicos de este trabajo por medio: de un estudio estático –a través del análisis de diversas normativas legales y de enfoques interdisciplinarios– y de una visión dinámica –que es ofrecida por la estrategia en el Derecho–.
