RESUMENMuchos exégetas de la filosofía política medieval han sugerido que el Defensor Pacis de Marsilio de Padua defiende una perspectiva «positivista» sobre el derecho. En este artículo intentaremos mostrar que esas interpretaciones están equivocadas. Comenzamos ofreciendo un breve resumen de la doctrina legal de Marsilio y luego repasamos varios comentarios textuales tanto a favor como en contra del «positivismo jurídico» en el Defensor Pacis. Revisando las teorías más reciente acerca del «positivismo jurídico», argumentamos que no existen evidencias de ninguna perspectiva positivista sobre el derecho que sea coherente en la obra de Marsilio y que, si las hay, son irrelevantes para la filosofía política de Marsilio de Padua. ABSTRACTMany scholars of Medieval Political Philosophy have suggested that Marisilius of Padua's Defensor Pacis defends a «positivist» approach to law. In this article we try to show that such claim is wrong. We begin by sketching a brief summary of Marilius' legal doctrine and then we turn to many scholarly pieces that have found it either in favor of or against «juridical positivism» in the Defensor Pacis. By reviewing the most recent theories on «juridical positivism» we argue that there are no evidences of any coherent «positivist» view of Law in Marsilius' work and, that if there are, they are irrelevant to Marsilius' political philosophy.
RESUMENEste trabajo intenta reconstruir el concepto de "pueblo" en la teoría política de John Locke a partir de su teoría del consentimiento. En primer lugar analizamos la noción de "resistencia política" que arroja importantes elementos para caracterizar al pueblo lockeano. Posteriormente complementamos dicho enfoque con la hipótesis de que la distinción entre consentimiento expreso y tácito es clave para determinar quién forma parte del pueblo, mientras que intentaremos mostrar que los análisis de esta distinción centrados sólo en el deber de obedecer las leyes se muestran insuficientes. PALABRAS CLAVE: Locke, representación, pueblo, resistencia, consentimiento ABSTRACTThis paper aims to reconstruct the concept of "people" in the political theory of John Locke considering his theory of consent. First, we analyze the notion of "political resistance" that provides important elements to characterize the Lockean people. We then complement that perspective with the hypothesis that the distinction between express and tacit consent is key to determine who can be part of the people, as we try to demonstrate that the analysis of this distinction solely focused on the duty to obey the law turns out to be insufficient. KEYWORDS: Locke, representation, people, resistance, consent I. IntroducciónEn este trabajo indagaremos la noción lockeana de pueblo a partir de su teoría del consentimiento. Dado que es el pueblo, cuando cada individuo abandona el estado de naturaleza y se une a la sociedad civil, el que constituye el poder político pero también el que se resiste a éste cuando sufre alteraciones o viola su confianza, resulta de enorme importancia determinar quiénes pueden formar parte de este cuerpo político. Bajo la hipótesis de que la distinción entre consentimiento expreso y tácito es clave para determinar quién forma parte del pueblo, intentaremos mostrar que los análisis de la distinción centrados sólo en el deber de obedecer las leyes se muestran insuficientes.Asimismo buscaremos reparar en que, para obtener una perspectiva más rica de la teoría lockeana, debemos atender a otros tipos de deberes que conlleva la membrecía al Estado.Dedicaremos un primer apartado apartado, en consecuencia, a desarrollar la teoría lockeana de la constitución de la sociedad civil y el pueblo, así como su doctrina de la resistencia civil. En este trabajo trato de demostrar que Nino no logra articular un liberalismo completamente antiperfeccionista en su respuesta al comunitarismo. Para ello, parto de reconstruir el diagnóstico que Nino ofrece de la crítica comunitarista al liberalismo y señalo que para darle respuesta se compromete con una concepción particular del bien basada en la idea de autorrealización autónoma. En la siguiente sección desarrollo la manera en la que esa concepción del bien da forma al liberalismo de Nino y, en el apartado siguiente, la confronto con un experimento mental destinado a evaluar si es capaz de bloquear distintas políticas estatales de corte perfeccionista. En la última sección ofrezco unas breves conclusiones respecto al modo en el que la adopción de una concepción del bien particular limita las pretensiones antiperfeccionistas de su teoría liberal.
