Observando o cenário atual, acerca dos desafios relacionados à salvaguarda da criança, visando manter a integridade do menor frente a situações de abuso sexual, percebe-se que, no Brasil, esse é um problema recorrente, cometido, sobretudo, por pessoas da própria família ou ocultado por esses. Assim sendo, esta pesquisa visa abordar, com base em estudos realizados sobre essa temática, a proteção do menor em face de salvaguarda em decorrência de violência sexual praticada por ou com a conivência de genitores ou responsáveis, tendo como propósito trazer o seguinte questionamento: como garantir a proteção do menor, vítima de violência sexual praticada por um parente, considerando todos os seus direitos e sua salvaguarda? O objetivo deste artigo é gerar uma reflexão acerca da importância da proteção da infância perante esses casos. A metodologia utilizada foi uma revisão integrativa a partir de buscas nas bases de dados eletrônicos Biblioteca Virtual em Saúde (BVS), Scielo e Google Acadêmico, entre os anos de 2012 e 2022. Como resultado, pode-se estabelecer que a demora durante o desenvolvimento do processo, que se inicia na notificação do caso e vai até o depoimento judicial e à aplicação das penalidades cabíveis, pode acarretar, para a vítima, além da falta de proteção necessária, danos físicos e psicológicos. Pode-se observar, também, com base nos estudos analisados, que os trâmites de salvaguarda à criança, conforme previstos pelo Estatuto da Criança e do Adolescente (ECA), não são contínuos, o que se caracteriza como uma contrariedade para a justiça brasileira. A conclusão a que se chegou é que a proteção na infância é uma prioridade constitucionalmente estabelecida, no entanto, esse processo ainda não é efetivamente eficaz. Assim sendo, há uma necessidade de políticas públicas consistentes que facilitem e acelerem a salvaguarda dessa criança, protegendo-a na convivência com o genitor agressor.
