O artigo discute aspectos da crise do sistema de justiça brasileiro que estão no centro do debate sobre a necessidade de reforma do Poder Judiciário, com base na crítica geral ao anacronismo, inoperância e à desigualdade de acesso aos seus serviços. A autora apresenta a posição dos próprios integrantes do sistema de justiça brasileira através da análise de resultados de pesquisas realizadas pelo IDESP a partir de 1993. Alguns destes resultados têm apontado, ao longo do tempo, para uma flexibilização do espírito corporativo dos membros do Judiciário, como por exemplo, a aceitação de sua democratização. Os resultados também mostram que o controle externo a este poder e a sua composição, embora incorporada pelos juízes antes refratários a esta discussão, permanece uma importante divisão no interior da magistratura.
The article discusses the crisis of the Brazilian System of Justice and some of the central aspects of its Reform propositions, like its anachronism, malfunctioning and the unequal access to the justice services. The author presents the positioning of Justice members about these issues based on survey researches conducted by the IDESP since 1993. Some of the survey results indicate that corporatism has diminished in the past recent years, what is expressed, for example, through the acceptance of democratization of the Justicial power. The results also show that the external control of the Judicial Power remains as one of the central problems

Poverty is a condition that should be discussed not only from a socio-political point of view, but, also, legal. There are several historical rights, nowadays sculpted in the Brazilian Federal Constitution, destined to people in this condition. The criminal and criminal procedural law share many of them with the support of State initiatives as the structuring of offices for public defenders. However, despite the great textual advances of the laws, the daily routine during lawsuits and penitentiaries denounces a very different reality.
This chapter examines the performance of the Public Prosecution — a Brazilian institution tasked with exercising oversight and control over public administration — and its impact on democracy. It is argued that the institution is still attempting to define itself both internally and externally. Work by the Public Prosecution has generated significant response from groups who feel that their interests are being threatened. Amendments have been proposed in Congress to restrict the Public Prosecution’s autonomy.
