This article explores how the idea of procedural justice can help us to rethink juvenile justice and research children’s rights in Europe differently. To frame the following argument, we will question four implications of the procedural justice perspective: 1) the need to implement rights and not just proclaim them, 2) the need to investigate a ‘double perspective’ on children’s rights implying both juvenile justice professionals and children in conflict with the law, 3) the child’s right to effectively participate and be involved in the process and 4) the idea that age matters in the judicial reaction to crime. The resulting conclusions and discussions revolve around the scientific consequences and challenges we must face when we take procedural justice perspective seriously.

Resumen La justicia de menores interviene cuando los adolescentes cometen delitos con el objetivo de responsabilizarles por los hechos realizados, favorecer su reinserción social y evitar la consolidación de carreras delictivas. Ahora bien, las razones por las que se produce la intervención, las condiciones en que se realiza, su finalidad educativa, o el hecho de que quien juzga sea un adulto y el juzgado un menor de edad favorece que, en ocasiones, la tarea de juzgar el delito se torne en una evaluación moral del joven a través de su comportamiento externo y la exteriorización de sus sentimientos y emociones respecto al delito y la víctima del mismo. En este trabajo nos interesa centrarnos en esa dimensión emocional de la tarea de juzgar, así como en los momentos procesales que pueden ser idóneos para vislumbrar las emociones de los menores respecto al delito cometido y el daño causado: Algo que puede fomentar que se reoriente la medida judicial, o se apueste, o no, por resolver el caso extrajudicialmente. Ese análisis preliminar mediante la revisión bibliográfica nos permite pensar en la distancia existente, o no, entre moralizar al menor y responsabilizarle por el delito cometido.
Este trabajo presenta algunas reflexiones sobre la posibilidad de que las distintas consideraciones éticas a tener en cuenta cuando se realiza investigación con niños y niñas no se perciban como simples recomendaciones, sino que puedan conformarse como un derecho que exige el cumplimiento de algunas obligaciones al científico social que investiga en ese contexto. Para ello se analizan algunas especialidades a tener en cuenta en este tipo de investigación, como son la disimetría y las relaciones de poder entre el investigador y el investigado; la revisión de cuestiones clásicas, como el consentimiento informado o la confidencialidad, o los condicionamientos que marcan la participación igualitaria y significativa del menor en la investigación. The right of children to be researched properly This paper presents some reflections on the possibility that the different ethical considerations to be taken into account when conducting research with children are perceived as a right and not just simple recommendations. To this end, we analyse some specific aspects of this type of research, such as dissymmetry and the power relations between the researcher and the researched, the revision of classical issues such as informed consent or confidentiality, or the conditions that mark the equal and meaningful participation of children in research.
La justicia restaurativa se ha convertido en una filosofía de resolución de conflictos con vocación global, que implica a las partes y procura la responsabilización del agresor y la reparación para las víctimas. Y entre las herramientas para hacerla efectiva en el ámbito judicial penal la más generalizada es la mediación, sobre todo en el contexto europeo. Sin embargo, a la hora de su implantación, no son pocas las resistencias tanto profesionales como institucionales, e incluso por parte de la ciudadanía. Para tratar de profundizar en ellas, y clarificar los retos de las políticas públicas en esta materia, el presente trabajo recoge los resultados de una investigación sociojurídica llevada a cabo en 2019 sobre justicia restaurativa y mediación penal intrajudicial en la Comunidad Autónoma de Aragón.
Restorative justice has become a conflict-solving philosophy with a global vocation, involving the parties and aiming for the accountability of the aggressor and reparation for the victims. Among the tools to implement it in the criminal judicial scope, the most extended is mediation, especially in Europe. However, there are many resistances to its implementation, both from the profession and from the institutions, and even from the people. In order to take a deeper look into these resistances, and to clarify the challenges that public policies are facing, this paper presents the findings of a socio-legal research carried out in 2019 about restorative justice and criminal mediation within the judiciary in the Autonomous Community of Aragon (Spain).
