RESUMOConsiderando as controvérsias relacionadas ao regime de responsabilidade civil da Lei Geral de Proteção de Dados Pessoais (LGPD), este trabalho pretende examinar aquele que seria mais eficiente enquanto maximizador de riqueza social a partir de uma perspectiva econômica. Após um breve estudo acerca dos regimes de responsabilidade civil, é apresentada uma discussão doutrinária em torno do tema, seguida pela análise econômica desses regimes. Conclui-se que a LGPD dá azo à existência de dois regimes distintos: objetivo, para relações de consumo, e subjetivo com culpa presumida, para os demais. Verificase que mais prevenção nem sempre é socialmente desejável e que o resultado será eficiente desde que o potencial ofensor assuma os custos do ônus probatório. Assim, o regime de responsabilidade poderá ser objetivo ou subjetivo com culpa presumida, sendo mais eficiente, especificamente às relações consumeristas, o objetivo.
