European Union member states which have been outside the euro area are obliged to join it as soon as they are able to fulfil the necessary convergence criteria. As a result of the financial crisis of 2008 and the consequences following it, euro area member states have adopted additional rules regulating its functioning which make the accession to the euro area even more difficult for those concerned. In addition to this some member states and EU institutions have proposed other measures which have as their aim to establish new institutions and organs involved with the management of the euro area.
The present paper aims at describing three of those institutions (the Euro Area Treasury, European Minister for Economy and Finance, European Monetary Fund) and to evaluate the potential impact of their entry into force on those member states who (as Poland and Czechia) have been outside the euro area. In order to achieve this aim the author analyses proposed changes in more details and provides an assessment.
Prezentowany artykuł ma na celu dokonanie klasyfikacji agencji zdecentralizowanych Unii Europejskiej. Jako podstawy dokonania klasyfikacji przyjęto podejścia: temporalne, instrumentalne, strukturalne i funkcjonalne. Przeprowadzona analiza pozwala stwierdzić, że szereg klasyfikacji agencji (np. dokonana ze względu na charakter ich kompetencji) dowodzi, że agencje bardzo często wymykają się próbom ich klasyfikacji. W związku z tym Autor zauważa, że pomimo ich znacznej wartości dla lepszego zrozumienia oraz uporządkowania działalności agencji i funkcji przez nie wykonywanych, wszelkie ich klasyfikacje należy traktować z dużą ostrożnością.
<p>Artykuł stanowi polemikę z książką D. Minich na temat idei władzy państwowej w koncepcjach G. Seidlera. Wykazuje sie, że autorka przytacza jedynie poglady G.L. Seidlera, nie wyprowadzając z nich żadnych wniosków.</p>
Stopniowe powiększanie się liczby organów UE, które wyposażone są w odrębną od niej osobowość prawną (multiplikacja osobowości prawnej organów UE), jest zjawiskiem zauważalnym w ramach funkcjonowania tej organizacji międzynarodowej już od dłuższego czasu. W jego wyniku doszło do powstania całego szeregu organów UE posiadających osobowość prawną, które zajmują różne miejsce w jej strukturze organizacyjnej i których podstawy prawne działania określone są w aktach prawa UE o różnej randze. Prezentowany artykuł stanowi próbę przedstawienia katalogu tych organów, a także określenia charakteru ich osobowości prawnej (autor bierze przy tym pod uwagę trzy możliwości, tzn. osobowość prawa międzynarodowego, prawa UE oraz prawa krajowego). Autor zwraca również uwagę na skutki, jakie wynikają dla funkcjonowania UE z multiplikacji osobowości prawnej jej organów. Jednym ze skutków jest to, że osoba prawna musi mieć własne organy wewnętrzne, które występują w jej imieniu w obrocie prawnym. W prawie UE istnienie organówwewnętrznych jej osób prawnych uwzględnione zostało przede wszystkim w kontekście ich zdolności procesowej w postępowaniach przed Trybunałem Sprawiedliwości UE, co widać na przykładzie organów wewnętrznych Europejskiego Banku Centralnego oraz Europejskiego Banku Inwestycyjnego. Skutki istnienia organów UE wyposażonych w osobowość prawną widać ponadto w kontekście przepisów prawa UE, które dotyczą wykonania budżetu UE.
It is a generally settled principle of international law that whenever a duty established by any of its rules has been breached by act or omission, a new legal relationship automatically comes into existence-an obligation to make some form of reparation1. As far as responsibility of states is concerned, the International Law Commission prepared Articles on Responsibility of States for Internationally Wrongful Acts in 20012. These articles do not however address the issue of responsibility of international organizations, hence in 2011, on its second reading, the ILC adopted the (draft) Articles on the Responsibility of International Organizations3. On its part, the Institute of International Law in 1995 published a 'private' codification on that subject4
