The purpose of this article is to attempt to understand some institutions of Polish animal protection law using the concept of “symbolic legislation”. The law is symbolic when, despite apparently ordering or prohibiting certain behaviours, it does not establish effective mechanisms for enforcing these obligations. The authors on selected examples show that in the field of animal protection law, there are no such symbolic solutions. At the same time, they indicate that not all of these situations deserve a negative assessment and come to the conclusion that the “symbolism” of regulation is not always the fault of the legislator himself. The concept of symbolic legislation allows a better understanding of how a legal act can affect social reality - among others, where there is a strong need for social education, such as in the field of animal protection.
Instytucja referendum w sprawach o szczególnym znaczeniu dla państwa budzi rozczarowanie piśmiennictwa, ponieważ nie spełnia ona swojego celu prima facie. Tym celem zaś jest umożliwienie obywatelom podejmowania wiążących decyzji politycznych w najważniejszych kwestiach. Mogłoby to skłaniać do uznania referendum za pustą obietnicę ustrojową oraz instytucję nieużyteczną, co jednak byłoby nietrafne i przedwczesne. Referendum może bowiem potencjalnie wypełniać istotne politycznie funkcje dodatkowe, takie jak szczególne legitymizowanie pewnych decyzji politycznych czy stymulowanie debaty publicznej. Celem artykułu jest przeanalizowanie referendum w sprawach o szczególnym znaczeniu dla państwa jako symbolicznej instytucji prawnej. Przeprowadzone badanie oparto na spostrzeżeniach prezentowanych w literaturze wobec zjawiska prawodawstwa symbolicznego (symbolic legislation), zastosowanych odpowiednio do wybranego fragmentu systemu prawnego, jakim jest pojedyncza instytucja. Referendum w sprawach o szczególnym znaczeniu dla państwa można więc postrzegać jako instytucję, której funkcje dodatkowe zasadniczo dominują nad jej celem prima facie. Jednocześnie publiczne deklarowanie tego celu prima facie wydaje się wpływać na potencjalny stopień realizacji funkcji dodatkowych. Przykładowo, wpływ na debatę publiczną, jaki osiąga się dzięki podjęciu czynności zmierzających do przeprowadzenia referendum, może być silniejszy, o ile uda się przekonać opinię publiczną, że w rzeczywistości chodzi o przekazanie pewnej decyzji obywatelom. W konkluzji zasygnalizowano, że realizacja dodatkowych funkcji referendum w systemie prawnym nie byłaby prawdopodobnie możliwa w inny sposób niż właśnie poprzez uczynienie referendum instytucją symboliczną. Nie oznacza to jednak, że doktryna powinna akceptować każdy przypadek wykorzystania referendum w celu realizacji którejś z jego funkcji dodatkowych, a w stosownej ewaluacji może dopomóc scharakteryzowany w artykule „test wstydliwości”.
Symbolic provisions of law lack effectiveness in the classic sense; moreover, the legislature using this instrument either accepts this lack of effectiveness or even intends it. Such provisions are adopted for the realization of either secret political goals or explicit goals – not by enforcing certain behaviours, but rather by shaping appropriate attitudes in the society. The aim of the study is to analyse the circumstances that may lead to the adoption of symbolic legal instruments. To implement this task, two examples from Polish legislation were selected, and then the circumstances of their adoption were analysed. In this way, several factors have been identified that may justify the fact that the legislature sought to establish: (1) symbolic provisions and (2) symbolic provisions intended primarily to attain secret political goals.
The deputy’s draft bill amendment about the Animal Protection Act submitted to the Marshal of the Sejm in November 2017 was one of the most ambitious attempts in the Third Republic of Poland to improve the legal protection of animals. The loudest proposal in the project was to prohibit the rearing and breeding of animals for the purpose of obtaining fur from them. In the article, the Authors reflect on the reasons for the political failure of this project. In the conditions of such strong centralization of political power, was the resistance from big business really decisive? What political conditions would have to be met for such far-reaching socio-economic changes motivated by public morality and environmental protection? Why this issue aroused so many contradictory emotions in political discourse? What is more important: economic profits based on cruelty to animals or life of sentient, autonomous beings?
