O presente artigo analisa o acordo de não persecução penal (ANPP) instituído pela Lei n. 13.964/2019, com enfoque no requisito da confissão formal e circunstanciada. A partir de ampla revisão bibliográfica, o trabalho busca definir a finalidade da confissão e estabelecer suas bases procedimentais, notadamente em relação ao momento apropriado para a sua realização. Sustenta-se que a confissão, além de constituir requisito formal para o ANPP, deve ser prestada necessariamente perante o Ministério Público em ato específico e tem como única finalidade possível fornecer eventuais novas fontes de prova ou meios de obtenção de prova até então não identificados na investigação, mas que foram ocasionalmente suscitados pelo investigado durante a confissão, inexistindo, não obstante, qualquer dever ou obrigatoriedade que o faça para ter direito ao acordo.
O presente artigo tem como objetivo debater alguns fenômenos surgidos principalmente em virtude da globalização e da “aproximação” entre as nações. Esse fato é resultante de questões de ordem global, com as quais os Estados possuem enorme dificuldade em lidar, especialmente o aumento do fluxo migratório de refugiados. Assim, houve uma transformação entre os modelos de políticas estatais, deixando de ser um Estado Social e tornando-se um Estado Penal. Além disso, cria-se um triste paradoxo, dotado de falácias e preconceitos de ordem social, cultural e religiosa, que muitas vezes afrontam a dignidade da pessoa humana em nome do direito à segurança.
