Intellectual property (IP) has become a crucial factor in scientific knowledge production which is based predominantly on profits and market relations facilitated by Intellectual property rights (IPRs). The result of this production is a 'proprietary knowledge', i.e. an over-patented knowledge which cannot be legally used or produced without the right holder's consent. This work aims to 'reopen' the debate about IP recalling the 'knowledge commons' argument in order to affirm a diversity of ownership definitions, e.g. individual, multiple, collaborative, communitarian and public. The article introduces a brief analyse about the philosophy underlying IP -from authors such as Locke, Hegel and Marx -for a critical appraisal of theoretical and social aspects of knowledge property. The discussion presented about contemporary IP and its consequences for scientific production, includes the study of a biopiracy case involving the Waoranis, an Ecuadorean indigenous community, as an example of the 'over-patenting' of life and knowledge. Thus, in favour of the 'knowledge commons' argument, the paradigmatic case about the donation of the malaria vaccine patent is revised to show that it is possible to organise a scientific production guided by alternative criteria. The methodology used was the critical revision of primary bibliography and academic literature. RESUMENLa propiedad intelectual se ha convertido en un factor crucial en la producción de conocimiento científico, que se fundamenta predominantemente en ganancias y relaciones de mercado, mismas que son facilitadas por los derechos de propiedad intelectual. El resultado de esta producción es un "conocimiento propietario", es decir, sobre-patentado que no puede ser legalmente utilizado o producido sin el consentimiento del titular del derecho. El objetivo es "reabrir" el debate sobre la propiedad intelectual con el argumento del "conocimiento común", para así, afirmar una diversidad de definiciones de propiedad, por ejemplo: individual, múltiple, colaborativa, comunitaria y pública. El artículo presenta un breve análisis sobre la filosofía subyacente a la propiedad intelectual -con la revisión de autores como: Locke, Hegel y Marx -para evaluar críticamente los aspectos teóricos y sociales de la propiedad del conocimiento. Este artículo fundamentado en el pensamiento rizomático de Deleuze y Guattari analiza diversas concepciones sobre cuerpos y territorios desde el período presocrático, incluyendo estudios de neurociencia y la propuesta epistémica de los feminismos decoloniales y comunitarios. Así, desarrollamos una reflexión teórica que critica las definiciones de cuerpo y territorio como «objetos dados» que se configuran como «cuerpos sin órganos» apropiados por el capitalismo y el pensamiento occidental. Nuestro objetivo es evidenciar al conocimiento como un agenciamiento relacional entre cuerpos y territorios que puede ser desarrollado por segmentaciones interseccionales alternativas. Por ello, la epistemología de los cuerpos y territorios asume que sin cuerpos no hay territorios, sin territorios no hay cuerpos y sin ambos no hay conocimiento.
El Ejército Zapatista de Liberación Nacional (EZLN), en enero de 1994, ejecutó un levantamiento armado en el Estado de Chiapas-México, con el objetivo de reivindicar los derechos y la autonomía de los pueblos indígenas. Este acontecimiento marcó un hito histórico en la región latinoamericana y en el mundo, ya que significó un resurgir de la resistencia al neoliberalismo y al capitalismo posterior a la disolución de la Unión Soviética. El presente artículo se pretende profundizar el análisis de la categoría ‘resistencia crítica’, considerando la configuración histórica y epistémica del zapatismo a través de sus discursos, prácticas e influencias internacionales. Para este fin, revisamos los postulados políticos del EZLN, su relación con el movimiento indígena ecuatoriano y el simbolismo del Subcomandante Marcos. La metodología utilizada consiste en la revisión bibliográfica de literatura especializada y de documentos, declaraciones, reportajes y material audiovisual sobre la historia del EZLN. Finalmente, nuestra conclusión es que la acción zapatista puede considerarse una “resistencia crítica” porque inicia con una reinterpretación y una revalorización de conceptos, categorías, experiencias y saberes indígenas, con la finalidad de des-imbricar las redes políticas, económicas y sociales del neoliberalismo.
