Wyznacza kres porządku ukształtowanego na mocy ustaleń kongresu wiedeńskiego z 1815 r., które stanowiły podstawę najbardziej ustabilizowanego i produktywnego wieku w dotychczasowych dziejach ludzkości 1. "Wielka wojna" rozpoczęła się w Europie, w której istniały zaledwie trzy republiki (nie licząc najstarszej, ale również najmniejszej republiki europejskiej-San Marino): Francja, Portugalia i Szwajcaria. Bilans wojny i kolejnych kilku lat okazał się dla państw monarchicznych zdecydowanie ujemny. W tych państwach, gdzie utrzymały się rządy monarchiczne, jak w Zjednoczonym Królestwie, we Włoszech, w Szwecji, Belgii czy Niderlandach, królowie nie mieli już sprawować realnej władzy, stopniowo ograniczani w swoich funkcjach do ról ceremonialno-protokolarnych 2. Wielkie monarchie Romanowych, Hohenzollernów i Habsburgów w ogóle przestały istnieć, a na ich ruinach powstały 1

Wielka Rada Generalna San Marino przyjęła ustawę 2 , która ostatecznie zniosła możliwość nadawania przez to państwo szlachectwa. Tym samym najstarsza na świecie republika 3 (istniejąca nieprzerwanie co najmniej od 1448 r.) zerwała z tradycją trwającą od setek lat. Już sam fakt nadawania szlachectwa przez państwo republikańskie zasługuje na uwagę. To, że praktyka ta dotrwała do XX wieku, rodzi pytanie o funkcje szlachectwa w republice. San Marino, które w początkowym okresie istnienia można określić nazwą wspólnoty (komuny), zaczęło z czasem przeradzać się w typową republikę miejską, formę ustrojową sięgającą korzeniami średniowiecza, spotykaną głównie we Włoszech 4. W średniowiecznych, północnych i środkowych Włoszech dominowały silne ośrodki miejskie podobne do rzymskiego municipium 5. Bogate miasta (jak Wenecja, Genua czy Florencja) zadbawszy o bezpieczeństwo w granicach murów miejskich, zaczęły podporządkowywać sobie kolejne tereny, kładąc podwaliny pod powstanie i rozwój odrębnych organizmów państwowych. The aim of this paper is to analyze the provisions of the "draft Constitution of the Polish State" of July 1917-an original achevement of the Polish doctrine of state law. In the opinion of the majority of contemporary representatives of Polish constitutional law, the activities of the Provisional Council of State of the Kingdom of Poland, as well as the Regency Council-bodies composed of Poles, but appointed by the German occupation authorities in 1916-1917, were meaningless, and the bodies themselves were imposed from outside and pursuing foreign interests. As a consequence, the value of the systemic achievements of these bodies and its meaning is denied.
