En este artículo de reflexión se expone de manera teórica la tensión existente en el plano jurídico entre el principio de confianza legítima y el principio de prevalencia de interés general. Así pues, se analizan los diferentes criterios de interpretación que ha utilizado la Corte constitucional para su resolución, en casos tan especiales como el de ocupación del espacio público por parte de vendedores estacionarios.
El sistema democrático colombiano, y en gran parte el Latinoamericano, se han visto envueltos por la influencia de tres fenómenos políticos como lo son el populismo, el elitismo político y el legado familiar, convirtiéndose en el derrotero de los líderes, partidos y movimientos ciudadanos que ambicionan el poder político. Este artículo tuvo como objetivo principal describir estos tres fenómenos desde la perspectiva colombiana. Y es producto de las revisiones bibliográficas realizadas durante la ejecución de la investigación denominada Consecuencias de la hegemonía de los congresistas en el poder de la rama legislativa colombiana desde 1968 hasta 2018. Dentro de los resultados alcanzados se destaca la política nacional empañada por estrategias que buscan nublar la capacidad de elección de las personas haciendo creer que lo popular es lo mejor, donde está el poder económico está el poder intelectual, y que un apellido representa seguridad.
