Der Europäischen Union wurden in den Verträgen für eine effektive Erreichung ihrer Ziele Kompetenzen übertragen. Ihr Vorgehen steht dabei jedoch stets in einem Spannungsfeld mit den Zuständigkeiten der Mitgliedstaaten, die bedacht sind, ihre eigenen Kompetenzen nicht zu weit einzuschränken bzw. an die EU abzugeben. Der Abgrenzung der Kompetenzen der Europäischen Union von denjenigen ihrer Mitgliedstaaten kommt für eine erfolgreiche europäische Integration daher eine wesentliche Bedeutung zu. Für die konsequente Einhaltung dieser Kompetenzordnung ist eine wirksame gerichtliche Kontrolle essentiell, die in dem vorliegenden Beitrag schwerpunktmäßig betrachtet wird. Dabei wird auf den EuGH ebenso eingegangen wie auf die ultra-vires-Kontrolle des BVerfG und sein neuestes PSPP-Urteil, das das Kompetenzgefüge der EU aufs Neue in seinen Grundsätzen in Frage stellt.
