A partir de la idea que es posible y necesaria, la creación de nuevos derechos fundamentales o la reconfiguración de los existentes para adaptarse a las nuevas exigencias de la Sociedad de la Información, se defiende la existencia de un derecho de acceso a la información pública. El catálogo de derechos fundamentales no está cerrado, ni es estático. El punto de partida de este nuevo derecho fundamental lo encontramos en el derecho a la información que es por sí mismo una derivación de la libertad de expresión. Como reiteradamente ha dicho el Tribunal Constitucional español, este derecho es esencial para que exista una opinión pública libre, imprescindible en un sistema democrático. Tal y como se hizo con el derecho a la protección de datos, el desarrollo del derecho de acceso a la información pública deberá realizarse por medio de una Ley Orgánica. Es una necesidad perentoria, no solo para cumplir los compromisos electorales, también por exigencias internacionales ya que España es el único país de la Unión Europea que con más de 1 millón de habitantes no tiene una ley de acceso a la información pública. La Coalición Pro-Acceso (www.proacceso.org) defiende 9 principios como punto de partida para elaborar dicha norma. Esos puntos se han redactado a partir de la normativa de otros países los tratados internacionales (Convenio del Consejo de Europa sobre el Acceso a los Documentos Públicos hecho en Tromsø, Noruega, el 18.VI.2009) y los principios creados por otras instituciones y organizaciones internacionales (TEDH, Corte Interamericana de Derechos Humanos…). En definitiva, porque todos tenemos derecho a saber.
Los Países Bajos cuentan con una ley de transparencia desde hace veinticinco años, España sólo desde hace tres. Con motivo del tercer aniversario, este artículo invita a reflexionar acerca de su implantación y las cuestiones a mejorar de ambas legislaciones, como la falta de vinculación a los derechos fundamentales, la ausencia de una mención a la transparencia en sus cartas magnas, los largos plazos de contestación o la ausencia de organismos de control efectivos. Así, desde un estudio comparativo de tipo cualitativo se pretende hacer una aportación constructiva, destacando la mejora en la posición de España según los criterios establecidos por la Alianza por el Gobierno Abierto pero incidiendo en la importancia de seguir progresando.
