A emergência de demandas por reconhecimento e redistribuição passam a fazer parte dos ordenamentos jurídicos, especialmente latino-americanos. Por outro lado, movimentos de reafirmação da hegemonia eurocêntrica começam a tomar forma a partir da perversão das construções jurídicas historicamente estabelecidas em favor de minorias, a exemplo do que vem sendo chamado de racismo reverso. Partindo de uma abordagem pós-estruturalista e decolonial, o presente artigo pretendeu compreender: de que forma o Direito (brasileiro) deve lidar com a ideia de racismo reverso? Para responder ao questionamento proposto, o texto foi separado em duas partes, que objetivaram, respectivamente, compreender de que forma e porque o crime de racismo surgiu, estabelecendo as bases para a análise de uma decisão judicial da Justiça Federal de Goiânia/GO, e realizar uma análise crítica da decisão judicial que julgou o suposto crime de racismo reverso, assim como dos possíveis motivos que levaram o Ministério Público Federal a proceder com a denúncia. Ao final, foi possível concluir que o Direito deve tratar a ideia de racismo reverso como ela é, inexistente. O Direito deve abraçar a diferença inscrita em grupos historicamente desfavorecidos, sob pena de continuar perpetuando uma hierarquia sem fundamento e em descompasso com a realidade das relações sociais.
Este trabalho traz relatos de experiência sobre as possibilidades de decolonialidade acadêmica advindas de pesquisas universitárias, desde que, sob perspectivas interculturais críticas, que questionem as estruturas vigentes. Entende-se a decolonialidade acadêmica como processos em que a Universidade e suas instâncias podem auxiliar e legitimar as ações e formações comunitárias autônomas, divergindo da maneira usual de como são estabelecidas as questões indígenas no interior das Universidades, geralmente sem a participação das comunidades, como objetos de estudo ou participantes esporádicos de eventos não remunerados. A partir do método da Pesquisa Ação, selecionamos uma demanda comunitária a ser resolvida pela pesquisa que resultou em Dissertação de Ciências Sociais. Como resultados desse estudo, coloca-se que é fato que, desde a promulgação de leis que obrigam as instituições a ministrarem em seus cursos temáticas que reflitam as versões indígenas sobre a história do país (Lei 11.645/08), tem havido um crescimento na visibilidade desses agentes e seus temas. Porém, são ações ainda teóricas ou com práticas isoladas, de professores e alunos, sem a participação efetiva da comunidade Por Fi Ga, configurando assim, uma interculturalidade funcional, conveniente ao Estado, que somente “encaixa” os agentes e temas em uma estrutura desigual já vigente. Acredita-se que os potenciais decoloniais da academia, residem na relação de respeito e reciprocidade entre seus funcionários, as pesquisas e a localidade, nesse caso, a comunidade Kanhgág Por Fi Ga. É preciso que a academia abra-se a aprender outras epistemologias, construindo espaços que realmente funcionem a partir da própria comunidade, valorizando o conhecimento a partir dos moradores.
