El derecho de propiedad lejos de ser una conceptualización pacífica, se ha encontrado históricamente en un campo de disputa. El Código Civil plantea una visión hegemónica caracterizada por un enfoque en el cual el derecho de propiedad no tiene ninguna relación con las problemáticas de la sociedad (como el acceso a la tierra y a la vivienda, el medioambiente, entre otros) resultando, más bien, un instrumento neutro que regula y ordena la relación de las personas con los bienes en la sociedad.En el presente trabajo revisaremos con las herramientas conceptuales de la teoría crítica al derecho de propiedad privada e inmueble del Código Civil. Analizaremos cómo esta regulación, que mayormente conceptualiza a un derecho de propiedad absoluto, exclusivo, perpetuo y sin límites, favorece situaciones de desigualdad que facilitan la falta de acceso a la tierra y a la vivienda de los sectores populares.Ahora bien, lejos de esa conceptualización, existen otras formas de entender y regular la propiedad. El marco internacional de derechos humanos ha hecho un reconocimiento del derecho de propiedad que debe ser incorporado para reformular el derecho de propiedad inmueble del Código Civil y transformar las injusticias socioambientales que éste genera.Palabras clave: derecho de propiedad, código civil, sectores populares y vulnerables, teoría crítica, derechos humanos, derecho a la tierra, derecho a la vivienda.
