В статье рассмотрены проблемы, возникающие в ходе стоимостной оценке вреда, причиненного почвам, при применении «Методики исчисления размера вреда, причиненного почвам как объекту охраны окружающей среды», утвержденной Приказом Минприроды от 08.07.2010 № 238 (далее -Методика): 1) практика установления факта загрязнения, в соответствии с которой ряд химических элементов и соединений рассматривается как загрязняющие вещества; 2) применение фонового содержания элементов и соединений в почвах в качестве нормативного значения, что приводит к необоснованному завышению степени вреда, причиненного почвам, а также использование фонового содержания веществ, концентрация которых по итогам лабораторного анализа находится «ниже предела обнаружения»; 3) возможность толкования положений Методики, допускающих принятие субъективных решений при выполнении надзорных мероприятий. Обоснована невозможность применения Методики в судебно-экологических экспертизах. Показано, что для повышения объективности результатов необходима разработка перечня загрязняющих веществ с учетом реального вреда, который может быть оказан при увеличении их концентраций, и пороговых концентраций содержания вредных веществ, ниже которых они не рассматриваются в качестве загрязнителей.
