Em diversos casos a intolerância envolvendo a culpabilidade da vítima no Brasil é significativa, pois muitos ainda consideram que o crime sexual teria se dado em decorrência do comportamento da mulher, questionando sua roupa, seu modo de agir e até mesmo o local durante o ato criminoso. Sendo primordial proporcionar maior proteção às vítimas de crimes sexuais, avaliando as questões ligadas à dignidade sexual e os reflexos gerados pelo estupro, o advento da lei nº 14.425/21 torna-se fundamental gerando mudanças protetivas relevantes na legislação. Para tanto, procede-se à pesquisa bibliográfica. Parte-se da hipótese de que a lei nº 14.425/21 tem como base o caso da influenciadora digital Mariana Ferrer, a qual ocupava a posição de vítima de crime de estupro de vulnerável em um processo judicial, uma vez que estava sob efeito de álcool durante relações sexuais. No curso do processo, o advogado do réu expôs fotos da influenciadora humilhando-a visando inverter a situação a favor do seu cliente. Dessa forma, ressalta-se a necessidade de regular algumas situações ligadas à proteção de vítimas e testemunhas no curso das ações, principalmente acerca da coibição da prática de atos atentatórios à dignidade daquelas e estabelecer aumento de pena do crime de coação.
