Propõe-se tratar do controle judicial das políticas públicas de Administração Penitenciária. Defende-se o reconhecimento do direito fundamental à adequada administração penitenciária com fundamento no art. 5o, XLVIII e XLIX, da Constituição Federal. O procedimento de ponderação de princípios jurídicos permite, ao se confrontarem argumentos contrários e favoráveis ao controle judicial da função administrativa, reconhecer, diante de casos concretos, a eventual intervenção judicial.

A pós-modernidade intensifica a complexidade na compreensão e definição do interesse público. A razão instrumental revela-se insatisfatória à realização da função administrativa. Há necessidade, portanto, de serem compreendidos os desafios contemporâneos e o papel da motivação em concreção ao interesse público.
Trata-se das práticas contemporâneas do Estado brasileiro, especificamente sobre o conflito entre a liberdade e a segurança jurídica, e de qual modo esta tensão fez-se presente nas orientações político-jurídicas de formação e desenvolvimento do Estado de Polícia, posteriormente, do Estado de Direito, e a repercussão atual junto ao Direito Administrativo, notadamente ao serem atribuídos os papeis entre o Estado e a livre-iniciativa.
