Los ciudadanos están llevando cada vez más sus demandas de salud pública no atendidas a los litigios judiciales para lograr soluciones del deber constitucional del Estado de proporcionar servicios y bienes de salud pública. Los estudios sobre este fenómeno se centran en cómo la Judicatura puede actuar sin infringir la separación de poderes y garantizar la eficacia de los derechos constitucionales. Este artículo presenta un panorama general de la actuación de la magistratura brasileña en la garantía de los derechos fundamentales de la salud. Los conceptos aplicados en la investigación concluyen que el problema debe resolverse desde sí mismo y no por la solución. La judicialización y el activismo judicial son medios alternativos y no obligatorios para resolver las demandas de salud pública, porque el Poder Judicial no es responsable de formular políticas de salud pública. Esta investigación contribuye a mejorar la tesis sobre este tema, ya que vincula varios contenidos de otros investigadores, académicos de renombre y jurisprudencia actual.
