El teletrabajo es una forma de organización laboral que se desarrolla bajo el uso esencial de la tecnología, ante la pandemia del COVID-19 se ha constituido como una herramienta clave para la educación superior. El objetivo de esta investigación fue analizar las repercusiones laborales, sociales y tecnológicas del COVID-19 en el teletrabajo y las directrices para su implementación frente la pandemia. La metodología utilizada consistió en una investigación de tipo exploratoria, por cuanto, existe poca literatura reportada sobre el tema de estudio, descriptiva y para la recolección y análisis de la información se recurrió a la revisión de las bases de datos: SciELO, Latindex, Scopus, Redalyc, Dialnet, durante los últimos cinco años, además de otras fuentes documentales nacionales e internacionales. La educación superior pública y privada implementó el teletrabajo para garantizar el derecho constitucional a la educación y dar continuidad a las relaciones de trabajo, enfrentando barreras de tipo laboral, social, tecnológico y familiar generadas por la pandemia. La implementación del teletrabajo para la educación a distancia en pandemia requiere el establecimiento de directrices que permitan obtener resultados favorables para Instituciones, docentes y estudiantes, por tanto, deben realizarse estudios que involucren a todos los actores sociales.
En el presente manuscrito se detalla, la necesidad de que la Corte Constitucional, organismo con facultad exclusiva para conocer y resolver garantía jurisdiccional, intervenga en la ejecución de sentencias ejecutoriadas destacando el compromiso que le otorgó el constituyente al cumplimiento de las sentencias que declaran derechos u obligaciones para las instituciones públicas, sujetos de Derecho privado y las personas en general. Para lo cual se realizó un análisis de las características y exigencias que se derivan del derecho a la tutela judicial efectiva y a la seguridad jurídica constitucional ecuatoriana. Para lo cual se realizó una revisión sistemática, basada en Derecho a la tutela judicial efectiva y derecho a la seguridad jurídica. En donde se concluye que es de vital importancia que el Estado ecuatoriano, cumpla con las principales garantías como el acceso a la justicia gratuito; el acceso a la justicia no se debe ver mermado por la falta de observancia en las formalidades del proceso, siempre y cuando las faltas de estas formalidades no impliquen un cambio sustancial en la resolución del proceso, conforme el artículo 169 de la Constitución y el principio pro actione; imparcialidad, así como la celeridad con la que se debe administrar justicia; y se garantice el cumplimiento de las resoluciones tomadas por la justicia.
El presente artículo de investigación se fundamenta en el estudio del léxico jurídico y como este ha evolucionado del lenguaje ordinario a un lenguaje técnico, la necesidad de los juristas de implementar un lenguaje claro y preciso, evitando las ambigüedades con el uso de palabras precisas y justas alejándose así de todo riesgo de malas interpretaciones. Es menester plasmar la relevancia que denota el lenguaje técnico jurídico y como la terminología de este se ha forjado a través de construcciones arcaizantes, frases formularias, latinismos, perífrasis y otros usos lingüísticos que resalta la esencia del verdadero léxico jurídico. A través de esta investigación se pretende interpretar la estructura y características del léxico jurídico, así como las funciones que este desempeña en la vida practica de quienes ejercen la ciencia del derecho. Este artículo es producto de una investigación basada en una revisión bibliográfica, crítica, y documental recurriendo al método descriptivo-argumentativo. Para la elaboración de este artículo hemos acudido a revistas científicas como: Scielo, Redalyc, Dialnet y una búsqueda exhaustiva de libros jurídicos. Como resultado tenemos que la finalidad del léxico jurídico es la univocidad semántica, la economía léxica y la precisión conceptual o claridad entre quienes los expresan.
Se tiene por objetivo analizar el rol de la víctima como sujeto procesal en la legislación penal ecuatoriana, mediante la metodología de estudio de casos judiciales. Se puede indicar que el rol de la víctima como sujeto procesal en la actualidad está únicamente como un mero enunciado, debido a que no existe normativa capaz de exigir que una víctima desempeñe o asuma dicho papel de manera responsable, sino únicamente hasta donde satisfaga muchas de las veces sus objetivos personales, por ello al efectivizarse dichos derechos estos no siempre van ligados a la búsqueda de la verdad y la justicia que serían los objetivos de toda sociedad; con la reforma planteada es decir de establecerse la obligatoriedad en la recepción del testimonio anticipado para la audiencia de formulación de cargos de manera general y en todo tipo de delitos penales se podría asegurar resultados efectivos en las investigaciones.
Se trazó como objetivo analizar los medios judiciales a través de los cuales los operadores de justicia aplican el principio de oportunidad como mecanismo de extinción del ejercicio de la acción penal pública en el cantón “La Troncal”. De tipo descriptiva. Los hallazgos encontrados, demuestran que la aplicación escasa o no aplicación del principio de oportunidad causa efectos desfavorables en el plano jurisdiccional y social. Este genera una alta carga procesal que conlleva al estancamiento de los procesos y demora la respuesta judicial. También afecta directamente la eficacia del sistema penal y la aplicación de figuras que cuentan con el respaldo del ordenamiento jurídico y que, a su vez, impide que, según una valoración apegada a derecho, se elijan aquellos casos a quienes aplicar el principio y se enfoque la persecución penal en delitos de mayor gravedad.
