Las tecnologías de la información y de la comunicación han revolucionado el mundo del trabajo reforzando, entre otros aspectos, el poder de vigilancia empresarial. Esto ha afectado a los derechos más básicos de los trabajadores, entre ellos, a su privacidad, de una forma ciertamente invasiva. Más aún, este control empresarial a través de las herramientas tecnológicas a veces no resulta ser del todo transparente u honesto, sino que puede llegar a invadir en la esfera privada de la persona trabajadora de forma inadvertida, creando incluso situaciones de discriminación.En este artículo, la autora reflexiona acerca de estos extremos que, a su vez, son objeto de ciertas controversias a nivel doctrinal y jurisprudencial, tratando de aportar una perspectiva crítica en favor de una mayor protección hacia la persona trabajadora y un fortalecimiento de la normativa laboral existente.
