El 27 de noviembre de 2007 fue sancionada la Ley de Presupuestos Mínimos de Protección Ambiental de los Bosques Nativos con el propósito de detener los desmontes crecientes y de garantizar la conservación de los bosques sobrevivientes. Esta ley resulta particularmente importante para analizar el juego de relaciones entre nación y provincias, porque permite observar tanto el modo en que las provincias responden al mandato constitucional de sancionar leyes complementarias en el área ambiental, como el impacto que estas leyes tienen en la conservación del ambiente. Este trabajo busca determinar cuáles son los alcances de la implementación de la Ley de Bosques en las provincias argentinas. Para ello, se realiza un estudio exploratorio teniendo en cuenta dos indicadores: la adecuación de las normativas provinciales a los criterios y estándares dispuestos en la ley nacional y la tasa de deforestación ilegal por provincia. Con base en estos indicadores, y partiendo de la literatura sobre federalismo, descentralización y políticas públicas, se sostiene que la implementación de la Ley de Bosques no es homogénea en todo el territorio nacional, sino que, en términos teóricos, responde a cuatro escenarios posibles: “implementación efectiva”, “juego de simulación”, “autonomía subnacional” y “carrera hacia abajo”.
Con el objetivo de detener los desmontes crecientes, en Argentina, el 27 de noviembre de 2007 fue aprobada la Ley de Presupuestos Mínimos de Protección Ambiental de los Bosques Nativos (N° 26.331). En comparación con otras leyes nacionales ambientales, esta ley presenta una serie de instrumentos normativos que podrían ayudar a detener los desmontes y, con ello, garantizar la protección ambiental y los derechos de los pueblos indígenas. A su vez, esta ley resulta importante para analizar la manera en que las provincias responden al mandato constitucional de sancionar leyes complementarias en el área ambiental.
Teniendo presente estos postulados, en este artículo se propone responder la siguiente pregunta ¿Cuál ha sido el nivel de acatamiento de los OTBN provinciales hacia la LBN entre 2008 y 2017? Para responder este interrogante, se plantea un estudio exploratorio en el que se comparan la totalidad de las leyes provinciales sancionadas hasta la actualidad en relación a los estándares y criterios establecidos en la ley nacional. En base al análisis efectuado y, teniendo en cuenta la bibliografía sobre federalismo ambiental, se sostiene que la aplicación de los estándares y criterios de la ley nacional es heterogénea entre las provincias argentinas.

La coordinación intergubernamental constituye un factor central para que las políticas nacionales alcancen una implementación homogénea. No obstante, dentro de los estudios sobre la coordinación se sostiene que, entre sus tipos, la coordinación horizontal (entre jurisdicciones de un mismo nivel de gobierno) tiende a no ocurrir. Poniendo en discusión este postulado, este trabajo se pregunta ¿Cuáles son los factores que producen que las jurisdicciones subnacionales decidan actuar de manera conjunta para implementar una política ambiental nacional? Partiendo del análisis comparativo del proceso de formulación de las leyes de adecuación normativa a la Ley Nacional de Bosques Nativos en Argentina, se argumenta que las provincias actúan conjuntamente cuando hay un marco institucional formalizado y legítimo disponible para ser utilizado en los momentos en que una estructura de incentivos produce que los políticos locales decidan formular e implementar una política ambiental homogénea en sus jurisdicciones.
