O presente trabalho tem como tema a problematização da teoria dominante dos direitos humanos a partir das epistemologias do Sul. Objetiva-se indicar as potencialidades decoloniais do Novo Constitucionalismo latino-americano com vistas nas lutas por direitos de povos subalternizados. Tal empenho afirma a importância dos processos históricos e textos de direitos humanos, como também provoca reflexões sobre a hegemonia colonial-patriarcal diante de realidades profundamente diversificadas. Para a sua realização, vale-se de uma pesquisa teórica interdisciplinar, qualitativa, de análise de conteúdo, possibilitando uma compreensão decolonial da problemática a partir da abordagem hipotético-dedutiva. Opta-se pela utilização do termo decolonial, e não descolonial, compreendendo que o termo representa uma resistência epistemológica, prática e política a partir de condutas insurgentes para promover propostas plurais. Afirma-se algumas concepções sobre colonialidade dos direitos humanos, analisando a sua limitação para o alcance de particularidades e pluriversidades de vidas subalternas, nas perspectivas que contemplem os discursos das lutas por direitos da forma como são praticados em diversas lutas por descolonização. Nesse sentido, potencializa-se a promoção de novas culturas de direitos humanos pautadas na pluralidade de anseios legítimos pela dignidade. Propicia-se elementos significativos para avanços nos debates que visam a consolidação de resistências diante dos fenômenos da colonialidade e da modernidade eurocêntricas. A partir das epistemologias do Sul, demonstra-se o desvelamento das relações de poder que se valem das categorias de raça e gênero, fortalecendo-se novas epistemologias e paradigmas decolonização e despatriarcalização da sociedade.
