O presente trabalho tem como objetivo abordar a incidência do CDC aos contratos de planos de saúde e o problema ligado a validade dos reajustes de mensalidade dos planos de saúde ocasionados pela mudança da faixa etária do beneficiário sob a égide do Estatuto do Idoso, da Constituição Federal e, principalmente, do Código de Defesa do Consumidor. Perante esse cenário a pesquisa fixou o seguinte questionamento: Quais são as balizas do Código de Defesa do Consumidor nas relações contratuais envolvendo planos de saúde? Com isso foram estabelecidos como objetivos: Demonstrar o papel do direito do consumidor na proteção dos contratantes de planos de saúde, descrever as consequências da judicialização da saúde suplementar e apresentar um estudo específico sobre a divergência jurisprudencial envolvendo o reajuste de mensalidades nos planos de saúde individual ou familiar em função da mudança de faixa etária do contratante. Para alcançar o desiderato utilizou-se o método descritivo, realizando uma abordagem de natureza qualitativa e o trabalho foi baseado em uma pesquisa bibliográfica. Ao final da pesquisa conclui-se que a aplicação do direito do consumidor nas relações entre as operadoras de planos de saúde e seus consumidores é essencial para o preenchimento das lacunas deixadas pela Lei nº 9.656/1998, bem como há uma necessidade da estruturação de critérios interpretativos sólidos para a tese que trata da validade dos reajustes de mensalidade de plano individual ou familiar fundado na mudança de faixa etária do beneficiário.
