Rumah merupakan salah satu kebutuhan dasar setiap orang disamping kebutuhan akan pangan (makanan) dan sandang (pakaian). Kebutuhan akan rumah beberapa tahun terakhir mengalami perkembangan yang sangat pesat salah satu faktor pendorongnya adalah besarnya jumlah penduduk. Pada kenyataannya terdapat persaingan yang sangat ketat antara para pengembang (developer) untuk menarik konsumen. Salah satunya dengan penjualan perumahan dengan sistem pre project selling. Dalam pelaksanaan penjualan perumahan dengan sistem pre project selling tidak berjalan sesuai dengan yang diperjanjikan para pihak, seperti adanya ketidaksesuaian antara apa yang diiklankan atau yang diperjanjikan oleh pengembang (developer) dengan kenyataan ketika rumah selesai dibangun sehingga hal tersebut dapat merugikan konsumen. Hasil penelitian menunjukkan bahwa pelaksanaan jual beli dengan pre project selling survei lokasi, pembayaran biaya pemesanan (booking fee), melakukan BI Checking, pembayaran uang muka (down payment) dan akad. Permasalahan dalam pelaksanaan Permasalahan yang ditemui dalam pelaksanaan jual beli perumahan dengan sistem pre project selling, seperti pada perumahan Aldi Residen terdapat ketidaksesuaian yang diperjanjikan dengan kenyataan ketika rumah telah ditempati, seperti fasilitas yang disediakan berupa jalan beraspal, akan tetapi sampai sekarang jalannya belum diaspal. Hubungan hukum antara calon pembeli dengan pengembang dilandasi dengan perjanjian jual beli. Background related to case No. 0081/Pdt.P/2014/PA.Bsk was triggered by a problem where the assembly had tried to advise the applicant to approach and persuade the guardian of the applicant (the applicant’s father) to marry the applicant to the applicant’s future husband; however, it did not work. Meanwhile, the applicant stated that she still wanted to marry the applicant’s future husband. In addition, the assembly also advised the applicant’s father so that he would be willing to become the guardian of his daughter but the attempt was also unsuccessful. The reading of the applicant’s request stated that the applicant retained its the request contents. This study applies an empirical juridical approach which obtains data by referring to the juridical and empirical aspects as a tool. Based on the results of the study, the nasab guardian from the bride candidate did not want to marry his daughter to her future husband because of communication problems that were not built effectively. Thus, the nasab guardian assumed to refuse to marry his daughter to him because he did not participate in educating, caring for and raising this daughter. In determining the adhal guardian in case No. 0081/Pdt.P/2014/PA.Bsk, the consideration of the judge of the 1B Class Religious Court of Batusangkar was that the applicant’s guardian was present at the trial but he objected (reluctant) to become the applicant’s marriage guardian. In this case, the objection from the applicant’s guardian was groundless. Therefore, the assembly stipulated that the applicant’s guardian is adhal (reluctant). The marriage process carried out in Religious Court in the case of adhal guardian includes: 1) Delivery of files related to marriage data, 2) Marriage Registration Officer summons interested parties such as bride and groom, 3) Marriage Registration Officer records the marriage process, and 4) Implementation marriage contract.
The objectives of the present research are: 1) to know the Provision of Child Adoption according to Positive Law in Indonesia Viewed from the Perspective of Law Number 35 of 2014 regarding Child Protection; 2) to know the Legal Protection on Child Inheritance Right; 3) to know How the Legal Consequence for the parties in the child adoption without court judge ruling. This is a descriptive research in which the problem approach is judicial empirical and it uses two data sources namely primary data and secondary data. In terms of unknown chilld background, then the child’s religion is adjusted to the local community’s religion in majority. This child adoption causes legal consequence both for the biological parents that must be responsible for fulfilling all child’s needs and for the government. With this child adoption, the biological parents that must be responsible for this can move their obligations to the adoptive parents. By this child adoption, all rights and obligations of the biological parents are moved to the adoptive parents. Besides, the legal consequence for the adoptive parents in this child adoption is the presence of obligation to fulfill all their adopted child’s needs as what they give to their biological child.
