Palabras claveDerechos humanos / movimientos sociales / movilización legal / género y sexualidad Sumario: LG'hBT han implementando una actividad de litigio constitucional estratégico con el objetivo de obtener la igualdad legal entre las parejas homosexuales y heterosexuales. El objetivo de este artículo es mostrar cómo la jurisprudencia que la Corte Constitucional ha creado para responder a esa demanda social, ha generado efectos contradictorios en términos democráticos. No cabe duda de que ha enriquecido la participación ciudadana en el debate sobre los derechos de las parejas del mismo sexo gracias al fortalecimiento de un contra movimiento religioso dispuesto a hacer presión sobre las autoridades con base en un lenguaje de derechos fundamentales. Sin embargo, también ha generado un déficit democrático debido a que la Procuraduría General de la Nación, una de las autoridades más importantes del Estado colombiano, ha sido capturada por católicos intransigentes e integristas. Debido a esta situación, los recursos de esta poderosa institución han sido utilizados para evitar el reconocimiento y la protección de los derechos de las personas homosexuales a contraer matrimonio y a adoptar menores de edad, a pesar de que las principales funciones de esta autoridad pública son defender los derechos humanos de los ciudadanos y castigar las faltas disciplinarias cometidas por los servidores públicos.1 Docente investigadora del Departamento de Derecho Constitucional de la Universidad Externado de Colombia y candidata a doctora en Derecho por la Universidad Panthéon-Assas, París II, en cotutela con la Universidad Externado de Colombia. Este paper, que fue presentado en el encuentro anual la Law and Society Association en el 2014, hace parte de un proyecto de tesis doctoral relativo al uso que le han dado al derecho constitucional los grupos de presión que se han movilizado en Francia y en Colombia para defender sus intereses frente al matrimonio y a la adopción por parte de parejas del mismo sexo, bajo la dirección de Juan Carlos Henao y Nicolas Molfessis.
Partiendo del análisis de expedientes judiciales, de actas parlamentarias y de entrevistas semiestructuradas, este artículo de investigación busca contribuir al estudio de la influencia que el contramovimiento católico conservador colombiano ha ejercido sobre la formulación de las normas jurídicas, así como al de las razones que explican su interés por la legislación relativa a la familia. Para ello, en una primera parte, se muestra que, entre 2009 y 2015, la movilización en contra del reconocimiento de la igualdad de las parejas conformadas por personas del mismo sexo fue organizada por católicos integristas que defienden un Estado confesional y por laicos intransigentes que actúan de conformidad con su deber religioso de evangelizar el derecho. En una segunda parte, luego de demostrar que el modelo católico de la familia sobrevivió al proceso formal de laicización del derecho civil, se demuestra cómo algunos activistas se opusieron al matrimonio igualitario para asegurarse de que la legislación civil no se desligara de dicho modelo y, por esta vía, garantizar la dominación y la supervivencia de su estilo de vida.
