On the turning point of European and world history, it is extremely important to unveil and effectively utilize the potential of effective high-quality education to make the future better for generations to come. Higher education quality management through accreditation has a long history of development in the United States, and time-proven standards, stimulating accredited institutions to continually improve academic quality. The concepts, systems, principles and practices of accreditation arouse in the United States out of the need to meet the demands for quality, and evolved over decades, to form a coherent set of standards and frameworks of continuous improvement in all meaningful directions of the educational institutions’ life, striving for teaching excellence and high learning outcomes. At present, accreditation principles and processes, as exemplified by the Accreditation Council for Business Schools and Programs (ACBSP) programmatic accreditation, are implemented in the US and numerous countries of the world, to ensure high standard and continuous improvement of business education quality, to raise the competitiveness of educational institutions in response to the expectations of public (primarily, students and their families), governments, employers, universities/colleges, academics, and broader communities. This study establishes the correlation of the quality management system via ACBSP accreditation with the continuous improvement of business education quality. This study also provides statistical evidence that the application of quality management principles at institutions of higher education with accredited business programs did result in the association with enhanced student learning outcomes. Higher education quality management leads to higher employability of the institution’s graduates. Since the quality of education is crucial for the country’s economic growth and prosperity, the business education institutions and programs in Ukraine and other Central and Eastern European and Eurasian countries may benefit from implementing quality management through ACBSP accreditation for their undergraduate, graduate, and postgraduate (doctoral) business programs, to satisfy ever-rising expectations of candidates for top managerial and leadership positions. The research suggests that 51% of the institutions of higher education with business programs in the United States, and 93% of the institutions of higher education worldwide could benefit from implementing accreditation principles and processes to maintain and enhance their education quality and competitiveness in the world business education market, for the sake of highest recognition of their graduates’ diploma on the global job markets and significant increase of their employability.
A historical review was conducted on Fred Fiedler’s Contingency Model to determine how this model has been used over the past 30 years since 1980. Fred Fiedler’s Contingency Model was created in 1967 to move the field of organizational research from analyzing traits and personal characteristics of leaders to assessing leadership styles and behaviors. The premise of the model is that the individual’s leadership style is the result of their life experiences, making it a fixed characteristic that is extremely difficult to change. Over the years, this model has been used with the aim of improving its validity and reliability in a multitude of national and international organizational settings. The article begins with a brief review of Fiedler’s background, progresses with a detailed description of Fiedler’s Contingency Model, and chronicles Fiedler’s Contingency Model’s use in the past and the present from 1980 to 2022. As a result, two major implications were found. The first implication was that the frequent use of the model had strengthened its validity and reliability, where it was one of the models that were readily used in studies focused on organizational leadership. The second implication was that the findings from these studies were used to address leadership problems that the organization needed to resolve. Based on these implications, it is safe to conclude that this model will continue to be used in future studies, where it will be fascinating to see how the results from Fiedler’s Contingency Model will benefit the organizations moving forward. Challenges facing many workplaces is the issue where supervisors’ leadership style may not fit specific work situation which leads to conflict with their employees. Fiedler’s Contingency Model provides a tool that can be used to identify and place supervisors in the best work situation where the supervisors’ leadership style can be the most effective.
The article discusses Role play, Simple Question, Journal writing as techniques for teaching Business Law to Business Administration students. The educator’s perspective is believed to have a dramatic effect on the choice of teaching methods and techniques. From a management point of view, the understanding of law underlies a strategy to avoid lawsuits. The introduction of teaching approaches and techniques that respond to the graduates’ professional and human needs, such as role play, simple question and journal writing, is described as humanizing the teaching of Business Law, intended to arouse motivation and enhance learning outcomes for Business Administration students. The article describes a step-by-step methodology of implementing the above teaching techniques in the real-time education process. The methodology has been approbated at Mount Saint Mary’s University Los Angeles in the Business Law course during the Spring Semesters since 2017, totaling 15 courses. By completing the Business Profile and Business Journal and actively participating in the role play process, the non-law students were able to practice public speaking, develop their research skills and gain an understanding of the management and legal perspectives’ application in the business environment. The quantitative evaluation of results was performed via program learning outcomes testing, and the qualitative evaluation – through unstructured post-test interviews with the participating students. The preliminary results used have been the comments provided by the End of Course Evaluations and the Peregrine Assessment of Associate of Arts Business degree program. Both quantitative and qualitative measurement showed increase in the program learning outcomes and students’ motivation and engagement. The impact on the Bachelor of Arts program will not be available until 2021. The experiences and results in using role play, simple question and journal writing have been used to provide recommendations for enhancing learning experiences and outcomes in teaching Business Law to non-law students.
Over the years employees have faced situations when their actions that previously received praise, were now seen as disruptive. Performance standards and reviews have changed so that the employee is under-performing. Colleagues that were once supportive become distant, critical or avoid interaction. Because of these changes the employee makes the decision to leave because of the intolerable working conditions, allowing management to conclude that the employee was at fault. This article analyzes the business mindset of upper management that engages in the silent discriminatory and retaliatory conspiracy of constructive discharge. Psychological, cognitive, legal and economic factors involved are analyzed with the use of grounded theory, case studies, legal and managerial analysis. Based on the discussion of legal and workplace environment, the author formulates recommendations for business and public institutions to implement.
One of the major tasks of the Business Law course is the acquisition and right application of legal concepts by business and public administration students. This article makes an insight into the inconsistency exposed through surveying the students' opinions on non-compete agreements. The study bases on the hypothesis that the business mindset which dominates American society influences the students' perception of this legal concept. Pursuing the aim to unveil the cognitive factors influencing the students' perception, the author traces the formation and historical dynamics of the concept of business mindset in the US, and its influence on popular attitudes to legal concepts resulting in the positive perception of non-compete agreement. Contributing to such positive perception was creation of a delusional myth compensating for the harsh reality of capitalism and euphemizing the words ‘capitalism’ and ‘capitalist’. The author offers actions to address students’ perception, in order to bring their subjective views and attitudes in compliance with legal reality and scientific worldview.
