Este artigo pretende mostrar, a partir da filosofia da linguagem de Wittgenstein e da teoria da ação significativa de S. Vives Antón, de que modo o discurso jurídico-penal acerca da corrupção não é um fenômeno empiricamente descritivo, mas, ao contrário, conceitual. Neste sentido, argumenta-se que se há uma narrativa metodológica sobre a corrupção, então, também deve ser verdadeiro pensar que há uma determinação conceitual que permite a manutenção do significado na avaliação da possibilidade ou não de sua consumação. Mas, efetivamente, poder-se-ia tomar o significado do termo corrupção independentemente de uma prática como sustenta a teoria da ação significativa de V. Antón? Haveria um binômio entre o conteúdo conceitual e os fenômenos que são por este descritos e abarcados? Ou, ao contrário, o discurso jurídico-penal continuaria a repetir o jargão culturalista ilustrado pela hipótese de que a melhor fonte para entender a corrupção deveriam ser as histórias produzidas por aquelas mesmas pessoas que tiveram o olhar mais próximo do fenômeno e, talvez, até mesmo foram cúmplices de ações corruptas? Mostra-se, por fim, que a corrupção engendra não apenas um problema lógico-dedutivo ao Direito Penal, mas também a pressuposição que a práxis está de um lado e, a norma, de outro, conforme concebe Vives Antón ao afirmar que a ação penal deve ser vista a partir de seu significado.
