Resumen. En este artículo analizaré dos importantes aproximaciones contemporáneas a la democracia ateniense. Se trata de las interpretaciones enfrentadas de dos helenistas que han arrojado nueva luz sobre el conocimiento de la democracia clásica. Mogens H. Hansen se ha centrado especialmente en el estudio de las instituciones como fundamento del poder democrático, mientras Josiah Ober, basándose en los textos retóricos, pretende reconstruir la ideología popular a la que hace responsable del dominio político del dêmos sobre la elite. Intentaré, a su vez, trazar las líneas de filiación teórica de ambas posturas y, para ello, abordaré una segunda cuestión, la de qué es la polis griega, un estado o una sociedad sin estado. Mi conclusión es que la lectura de Hansen está muy cercana a la historiografía liberal de G. Grote, mientras que la de Ober no es ajena a las lecturas antropológicas y comunitaristas.
The prevailing historiographic reconstruction of the political struggle in Athens during the last years of the fifth century originates from the discovery of the text of the Aristotelian Athenaion Politeia [Ath.]. According to this reconstruction, three political options and three political programmes were in effect. These were, on the one hand, traditional democracy and opposing oligarchy; on the other, a new third way, that of ‘the moderates’, who under the leading of Theramenes represents a solution to the stasis. The political program of themoderates is supposed to include the following fundamental items: a return to an ancient constitution (patrios politeia), the reduction of the number of citizens and their political rights, the sovereignty of law, and the recuperation of accord (homonoia) between citizens. This paper tries to highlight the weakness of this interpretation by analysing the difficulties in grasping from the sources this whole program and their adscription to a leader and to a distinctive political group. The misinterpretation was already implicit in the author of the Athenian Constitution, perhaps a disciple of Aristotle. He wrote influenced by the Aristotelian political theory and thereby he interpreted all that he had read about Theramenes, the Five Thousand and the patrios politeia as if the Aristotelian ideals of the mesotes (as a virtue) and of mese politeia (as the best possible constitution) were actually proposed and temporally achieved in Athens by the efforts of Theramenes and his supporters.
Variaciones en torno a la "interamericanización" del derecho. Aunque los países latinoamericanos han tenido tradicionalmente autoridades permisivas en sus fronteras que han permitido e incluso fomentado el tránsito de bienes, servicios, capital, personas, cultura, tecnología y conocimiento, en la actualidad este intercambio se ha intensificado y ha empezado a cuestionar las formas hegemónicas de creación del constitucionalismo latinoamericano.Los patrones particulares de desarrollo que la globalización del derecho ha creado para el derecho constitucional se explican a partir de las afinidades orgánicas (creación de tribunales independientes y mecanismos de garantía a los derechos y participación) y dogmáticas (principios y derechos consagrados de forma similar como disposiciones constitucionales) que caracterizan los procesos de reforma constitucional en la región durante los últimos 25 años.En esta complejización del fenómeno constitucional latinoamericano, por el mayor número de variables que entran en juego en su creación y desarrollo, adquieren particular relevancia el derecho extranjero y los instrumentos del Sistema Interamericano de Derechos Humanos. Dans cet article, nous soutenons l'existence d'une théorie articulée de la démocratie qui trouve son origine dans une nouvelle conception du nomos. Seule l'assemblée légitime la validité de n'importe quelle loi. On analyse aussi le rôle joué par le leadership du point de vue de la démocratie. Bref, on conclut en affirmant que le système doit être jugé et valorisé par ses réussites et pas uniquement en raison de ses contradictions.
