Predmetom tohto príspevku je poukázanie na dopady novej právnej úpravy týkajúcej sa ochrany osobných údajov na používanie súborov cookies za účelom zberu a následného spracúvania osobných alebo iných údajov používateľov, a to najmä s prihliadnutím na aplikáciu základných práv na ochranu súkromia a osobných údajov používateľa. Súčasne sú v tomto príspevku bližšie analyzované dve rozhodnutia Súdneho dvora, ktoré sa venujú problematike používania súborov cookies, a to vo vzťahu k identifikácii subjektu zodpovedného za ich používanie (vo veci C-210/16 Wirtschaftsakademie Schleswig-Holstein), ako aj konkrétnym požiadavkám kladeným na spôsob získania súhlasu používateľa so spracúvaním jeho osobných údajov prostredníctvom súborov cookies (vo veci C-673/17 Planet49).
Autori sa v tomto príspevku zameriavajú na posúdenie pôsobenia kolaboratívnych platforiem v konkrétnom odvetví ekonomiky-odvetví dopravy, jednému z najvýznamnejších sektorov kolaboratívnej ekonomiky. Predmetom tohto príspevku je konkrétne preskúmanie relevantnej judikatúry Súdneho dvora v predmetnej oblasti, a to vo vzťahu k charakteru služieb poskytovaných týmito platformami. Závery súčasnej judikatúry vzťahujúcej sa na posúdenie charakteru služieb spoločnosti Uber sú autormi aplikované aj na iné významné platformy pôsobiace v tejto oblasti na území Európskej únie, a to na spoločnosť Taxify a platformu BlaBlaCar. Nadväzne je v príspevku posúdený aj posledný návrh novely zákona č. 56/2012 Z. z. o cestnej doprave, ktorý o. i. zjednodušuje možnosť pôsobenia kolaboratívnych platforiem na území Slovenskej republiky.
Collaborative economy creates new business models in different sectors of the economy and produces new impulses for the development and innovations in the traditional areas. However, to answer the new questions arising from this segment of the economy, we must consider the existing legal framework regarding the central subjects of the collaborative economy-online platforms. In this paper we examine one legal aspect of particular relevance in this regard, specifically the liability of online platforms for content that they host. In particular, we consider the existing liability regime of these platforms, new proposals approved by the European Parliament and we conclude this paper with the critical examination of the liability regime in relation to the push for the adoption of voluntary proactive measures on the EU level.
The objective of this paper is to analyse the nature of services provided by collaborative platforms. In this regard, we consider the approach established by the European Commission in its European Agenda on Collaborative Economy, as well as the individual decisions of the Court of Justice which examined the nature of services provided by collaborative platforms Uber and Airbnb. On this basis we formulate the criteria that enable the classification of services provided by collaborative platforms as information society services or as underlying services. As the following step in this analysis we argue that it is necessary to establish not only the nature of services provided by collaborative platforms, but also the nature of the contractual relationships concluded between subjects participating in the collaborative economy.
