AbsztraktCél: A tanulmány célja annak a kérdésnek a komplex vizsgálata, hogy az Európai Bíróság milyen szempontok figyelembevételével ítéli meg a tagállami hatóságok azon döntéseinek uniós joggal való összhangját, melyben egy másik tagállambeli uniós polgár kiutasítására kerül sor.Módszertan: A tanulmány alapvetően az Európai Bíróság ítélkezési gyakorlatának rendszerező elemzésére, a legújabb ítéletek és azok szakirodalmi fogadtatása bemutatására vállalkozik.Megállapítások: A tanulmány fő megállapítása, hogy az Európai Bíróság a kiutasítások megítélésével kapcsolatos legújabb gyakorlatában a társadalmi integráció koncepcióját oly módon érvényesíti, hogy az nem csupán az uniós polgárok uniós jogból fakadó (és adott esetben a szabad mozgás jogára visszavezethető) jogait, hanem az uniós polgári jogállással együtt járó kötelezettségek teljesítését is figyelembe veszi. E körben egyaránt jelentősége van annak, hogy az uniós polgár büntetőjogi felelősségét megállapították-e (sőt, az Európai Bíróság újabb gyakorlatában már a tagállami büntetőjogon túl az uniós értékek esetleges megsértését is értékeli), valamint annak is, hogy az uniós polgár teljesíti-e a szabad mozgás irányelvből fakadó gazdasági követelményeket (az úgynevezett jó piaci polgár koncepcióját).Érték: A tanulmány által vizsgált témakört a hazai szakirodalom korábban még nem vizsgálta. Ezen túlmenően, uniós polgárként a más EU-tagállamban életvitelszerűen tartózkodó magyar állampolgárokat is érintheti a kiutasítások uniós joggal való összhangjának vizsgálata. A tanulmány a hazai jogalkalmazó számára hasznosítható következtetéseket is megfogalmaz.
