O presente artigo tem como objetivo realizar um estudo envolvendo as intervenções cirúrgicas realizadas em intersexuais recém-nascidos e a mediação sanitária. Utilizar-se-ão os métodos hipotético-dedutivo, hermenêutico e argumentativo, em vertente jurídico-sociológica e jurídico-projetiva. Em primeira abordagem, faz-se um breve escorço acerca dos intersexuais e seu direito à existência. Em seguida, as questões envolvendo o direito ao corpo e à saúde, bem como a possibilidade de mediação sanitária, serão aventados. Ao final, serão apresentadas as conclusões.
This paper aims to conduct a study involving surgical interventions performed on newborn intersexuals and health mediation. The hypothetical-deductive, hermeneutic and argumentative methods will be used, in the juridical-sociological and juridical-projective way. In the first approach, a brief foreshortening is made about intersexuals and their right to exist. Then, issues involving the right to body and health, as well as the possibility of mealth mediation, will be raised. At the end, the conclusions will be presented.
