Penelitian ini bertujuan untuk menganalisis efektivitas pengamanan Intelijen Kepolisian terhadap putusan pengadilan atas objek sengketa di Provinsi Sulawesi Selatan. Penelitian ini menggunakan metode penelitian studi empiris yang biasa pula disebut dengan penelitian hukum sosiologis, karena melihat penerapan hukum sebagai suatu kondisi faktual di lingkungan sosial dan hubungannya terhadap norma hukum. Penelitian ini dilakukan di Provinsi Sulawesi Selatan, dengan jumlah responden sebanyak 92 orang. Analisis data dalam penelitian ini menggunakan pendekatan kualitatif, dimana mengolah output dari kuesioner, dan disajikan dalam bentuk tabulasi frekuensi (F) dan distribusi persentasi (%). Hasil penelitian menunjukan bahwa pengamanan Ditintelkam Polda Sulawesi Selatan terhadap proses eksekusi atas objek sengketa di Provinsi Sulawesi Selatan berdasarkan Perkap BIN No. 2 Tahun 2013, dapat dinilai dari lima aspek, antara lain: Sasaran Pengamanan; Pelaksanaan Pengamanan; Koordinasi dan Administrasi; serta Pengawasan dan Pengendalian. Perolehan data dari keseluruhan indikator berdasarkan aspek-aspek pengamanan Ditintelkam Polda Sulawesi Selatan menunjukkan hasil yang kurang efektif. Dibutuhkan keseriusan dalam meningkatkan efektivitas pengamanan Ditintelkam Polda Sulawesi Selatan guna memastikan proses eksekusi putusan pengadilan atas objek sengketa bisa lebih efektif di masa akan datang.
This study aims to describe the simultaneous Village Head election disputes in 2016 and 2018 in North Luwu Regency. This research combines normative juridical and empirical research methods. The primary data were collected using direct interviews, while the secondary data was collected using literature study techniques. The data obtained in this research were then analyzed qualitatively to describe problems and answer study purposes. The results show the implementation of the simultaneous Village Head election of 2016 and 2018 in North Luwu Regency, consisting of 64 Villages. Of the 64 simultaneous Village Head elections, six of them are still considered to contain legal defects by several candidates. Accordingly, the six candidates submitted lawsuits against the simultaneous Village Head election results at the State Administrative Court to prove the violation. In this case, there are two lawsuits for Regent Decision No. 188.4.45/386/VI/2016 and four for Regent Decision No. 188.4.45/479/XI/2018. One of the six lawsuits was granted by the Judge in the Decision of the State Administrative Court, but the Decision of the State Administrative High Court voided the Court Decision of the first instance. In contrast, the other five lawsuits were immediately dismissed by the Judge at the Decision of the State Administrative Court. Therefore, it is recommended that the Regency Government be able to predict and provide solutions to a series of problems that will arise at all stages of implementing the simultaneous Village Head election. In this case, to minimize future disputes of the simultaneous Village Head election.
This article explores the practice of political dynasties in Southeast Sulawesi. Elections, which should have been a healthy democratic contestation, actually became a venue for local elites in Southeast Sulawesi to build and strengthen political dynasties since the 2014 elections. The elected legislators in the 2019 elections in Southeast Sulawesi came from many political families-families of regents, mayors and heads party. Ten regional heads from seventeen regencies / cities in Southeast Sulawesi succeeded in passing their families as legislative members from the Regency / City DPRD, Provincial DPRD, to the DPR and DPD. The electability of relatives of the local political elite is a threat in creating a substantial, competitive and quality democracy. Data collection in this research uses literature study and observation. The results found, political dynasties developed in Southeast Sulawesi in two models, namely dynasties that grew from elite governing families and non-governing elite families. The existence of this political dynasty is supported by four things: first, pragmatism and the practice of political party oligarchs; second, the flourishing of money politics and bureaucracy politicization; third, the weak supervision of Bawaslu and its staff; fourth, collutive and paternalistic political culture.
Penelitian ini bertujuan untuk memahami telaah hukum Mahkamah Konstitusi dalam Putusan MK No. 28/PUU-XI/2013 tentang Pengujian UU No. 17 tahun 2012 tentang Perkoperasian terhadap UUD NRI Tahun 1945. Manfaat dari penelitian tersebut ialah sebagai sosialisasi dan memberikan penyadaran hukum perihal aktifitas perkoperasian di Indonesia. Penelitian ini menggunakan pendekatan normatif yang berfokus pada mengkaji asas-asas peraturan perundang-undangan yang terkait dengan objek permasalahan. Teknis analisis yang digunakan dalam penelitian ini adalah metode analisis Hermeneutik dan Interpretasi. Hasil penelitian menunjukkan bahwa frasa “orang perseorangan” dalam pengertian koperasi berdasarkan Pasal 1 angka 1 UU No. 17 Tahun 2012 bertentangan dengan Pasal 33 ayat (1) UUD NRI Tahun 1945 karena rumusan pengertian tersebut mengarah ke individualisme. Lebih lanjut, meskipun permohonan para Pemohon hanya mengenai pasal tertentu, namun karena pasal tersebut mengandung materi muatan norma substansial, sehingga akan menyebabkan pasal-pasal yang lain dalam UU No. 17 Tahun 2012 tidak mempunyai kekuatan hukum mengikat. Oleh karena itu permohonan para Pemohon harus dinyatakan beralasan menurut hukum untuk seluruh materi muatan UU No. 17 Tahun 2012. Adapun demi kepastian hukum, UU No. 25 Tahun 1992 berlaku untuk sementara waktu sampai dengan terbentuknya Undang-Undang yang baru.
This study aims to analyze the implications of the TRIMs agreement for Indonesia. It discusses the exceptions to the TRIMs agreement, the utilization of transition periods, as well as the efforts of the Government to increase the investment value. This normative legal study uses statute, sociological, and comparative approaches with a literature study technique. The study results a show that Indonesia implements the TRIMs agreement, considering the exceptions and transition period. The Government’s efforts to increase investment include clear legal protection, improvement of human resources, a conducive investment environment, digital technology, innovative approach, and simplifying the investment process. Therefore, it is recommended that the Government strengthens investment regulations and policies that consider the development of society and the business world and increases investment in education and digital technology. The community must also actively participate in helping to increase investment by creating a conducive investment environment. With reasonable efforts and cooperation, investment in Indonesia is expected to increase and positively impact Indonesia’s economic growth in the 21st century.
