Postanowienia Modelu Konwencji OECD (Model Tax Convention on Income and on Capital) zawierają wiele definicji pojęć, którymi dokument ten operuje. Ponieważ przepisy umów opartych na nim są stosowane w różnych jurysdykcjach, gdzie terminologia podatkowa dotycząca relewantnych pojęć może być odmienna, pojęcia tożsame ideowo mogą mieć inny zakres. Wspomniane definicje zawarte są w słowniczku pojęć użytych w treści Modelu (i w traktatach na nim wzorowanych), który dołączono do art. 3(1) Modelu Konwencji, bądź też w przepisach dotyczących rozmaitych kwestii merytorycznych. Artykuł 3(2) Modelu Konwencji OECD stanowi: „Przy stosowaniu niniejszej konwencji przez umawiające się państwo, jeżeli z kontekstu nie wynika inaczej, każde określenie w niej niezdefiniowane będzie miało takie znaczenie, jakie ma ono w przepisach prawnych tego państwa w zakresie podatków, do których ma zastosowanie niniejsza konwencja, przy czym znaczenie wynikające z ustawodawstwa podatkowego tego państwa ma pierwszeństwo przed znaczeniem nadanym określeniu przez inne przepisy prawne tego państwa”.
