The artistic mask, understood as a “factitious”, creatively developed identity of a person, escapes the long-accepted, and already well-established in the private law, classifications of legal interests. This makes it difficult to answer the fundamental question of whether, and if yes, then subject to what conditions, the artistic mask is protected, and also to establish the legal framework for contractual disposal thereof. This problem becomes particularly important these days, as discussions across a variety of platforms are being held on the development of one’s own personality, self-creation, how we present ourselves to others, and how far we can control how others present us. Moreover, the structure of the mask draws our attention to the area where the material, or tangible, and the immaterial, intangible, interpenetrate each other, the area that is characterized by the conflict of interest, whether or not it pertains to property-related, or economic, interest. The academic research undertaken so far allows to conclude that there are many faces of the artistic mask. Therefore, a question arises whether it is possible at all to assign it to one of the categories of protected interest that is already recognized by the law, namely an image, a work or artistic performance, or it is a new type of legal interest. In our opinion, the problem of the artistic mask is not an anachronistic one, or an artefact from the times of a pursuit to find the grounds for protection of the artists-performers. The analysis of those who practice as performers allows us to observe that the structure of the mask combines two elements, i.e. the identity and the medium. It is a characteristic feature of the mask that everything that makes up the identity, namely the character, the appearance of an impersonated character, is not real, as it would be in the case of an image of a human being, but is artificially created. Unlike is usually the case with a copyrighted work, it is not a physical object that is the carrier, or the medium, for the mask, but a human being. It can be stated that in the case of the mask, the human being is the original copy of the “work”. However, the concept of holding copyright to one’s own person is excluded as such.
Tradycyjne podejście prawa prywatnego, uznające umowy mające za przedmiot odpłatne relacje uczuciowe i fizyczne, za sprzeczne z zasadami współżycia społecznego, może w przyszłości ulec zmianie ze względu na kilka czynników. Jednym z nich jest presja prawa podatkowego i zmieniającej się praktyki organów podatkowych w podejściu do tych rodzajów pracy seksualnej, które nie posiadają cech tradycyjnie rozumianej prostytucji. Innym czynnikiem jest wzrost znaczenia gospodarki cyfrowej, w tym rozwój działalności polegającej na świadczeniu przez Internet usług powiązanych w różnym stopniu z kwestią seksualności. Kolejnym jest duże zróżnicowanie rozmaitych typów związków uczuciowych i fizycznych, w których trudno o wytyczenie jasnej granicy między konkubinatem a związkiem opierającym się wyłącznie na odpłatnym utrzymywaniu długotrwałej fizycznej relacji. Jeszcze innym jest analizowana od pewnego czasu kwestia asystentury seksualnej dla osób z niepełnosprawnościami, która wiąże analizowane zagadnienie z nie branym dotychczas pod uwagę odmiennym kontekstem zdrowotno – etycznym. Celem artykułu jest przybliżenie owych czynników oraz szerszego kontekstu omawianych zjawisk, wykraczającego poza dyskusję na temat modelu reakcji państwa na zjawisko prostytucji. Tezą główną artykułu jest uznanie wieloaspektowości owych czynników wpływających na zmianę wykładni prawa, przy niezmienionym tekście przepisów. W konkluzji artykułu wskazano, że w dłuższej perspektywie czasowej nie jest możliwe utrzymywanie odmiennego spojrzenia na analizowanego zagadnienia w prawie publicznym i prawie prywatnym.
StreszczeniePrzedmiotem artykułu jest wykazanie możliwości ochrony pierwszeństwa odkrycia naukowego za pomocą konstrukcji praw osobistych prawa cywilnego. Ochrona ta jest niezależna od ochrony utworu naukowego gwarantowanej przepisami prawa autorskiego. Wybór podstawy prawnej powództwa (wskazanie na konkretne prawo osobiste) nie wiąże sądu. The article analyzes the concept of justice in both procedural and substantive aspects of civil law, with regards to John Rawls’ notion of “procedural justice”. The basic problem of the article is the question if each outcome of a fair procedure is just by the token of the fairness of the procedure. The author argues that such a standpoint, claiming that the procedure itself creates a just decision, will be incompatible with Article 45 paragraph 1 of the Polish Constitution. This paragraph grants the right to just adjudicature, which takes into account the whole substantive law. There are areas in law where conflicts between the procedural and the substantive justice are possible. Such an area is the adversary trial proceedings and evidentiary proceedings. The Court of Justice of the European Union emphasizes that there are such groups of legal entities (eg. consumers), for which it is necessary to regard ex officio all of facts pointing to the unjust treatment of consumer. The similar point of view was expressed by the Supreme Court of Poland. The Supreme Court of Poland allowed an evaluation of a claim which includes principles of justice, even if the defendant doesn’t take any position. This belief agrees with the standpoint of E. Waśkowski, who emphasized that the sentence should be “rightful”.
