ten im laufenden Vergabeverfahren, nicht interessengerecht, den am Auftrag interessierten Unternehmen abzuverlangen, den vermeintlichen Mangel zunächst selbst gegenüber dem Auftraggeber zu rügen, bevor sie einen Rechtsanwalt in erstattungsfähiger Weise mit der weiteren Wahrnehmung ihrer Interessen beauftragen können. Ob das Gleiche in allen denkbaren Fallgestaltungen, insbesondere auch bei Verstößen gilt, die i. S. von § 107 Abs. 3 Nr. 2 und 3 GWB erkennbar (vgl. dazu etwa Jaeger, in: MünchKommBeihVgR, § 107 Rn. 54) sind, ist hier nicht zu entscheiden.[19] Der Beklagte kann sich gegenüber der Gebührenersatzforderung nicht mit Erfolg darauf berufen, die fraglichen Kosten wären der Klägerin auch entstanden, wenn er, der Beklagte, sich vergaberechtskonform verhalten hätte. Auf den darin zu sehenden Einwand, der geltend gemachte Schaden wäre auch bei rechtmäßigem Verhalten des Schädigers entstanden, kann dieser sich ausnahmsweise dann nicht berufen, wenn dies mit dem Schutzzweck der verletzten Norm nicht vereinbar wäre (BGH, Urteil v. 24. 10. 1986 -IX ZR 91/84 = BGHZ 95, 157 ff.). So verhält es sich hier. Dem hier durchgeführten Vergabeverfahren, bei dem ein vergaberechtswidriges Wertungsschema verwendet worden ist, kann nicht im Wege einer fiktiven Alternativbetrachtung ein solches mit vergaberechtlich unbedenklichen Wertungskriterien gegenübergestellt und die hypothetische Prüfung daran angeschlossen werden, ob die Klägerin auch in einem solchen als korrekt fingierten Fall ihren Prozessbevollmächtigten mit der Prüfung der Vergabeunterlagen beauftragt hätte. Der Schutz des § 241 Abs. 2 BGB greift schon dann ein, wenn die Vergabeunterlagen, wie hier, in der Weise fehlerhaft sind, dass eine vergaberechtskonforme Angebotswertung nicht mehr möglich ist. Im Übrigen hat das Berufungsgericht keine Feststellungen getroffen, aufgrund deren die Haftung des Beklagten unter dem Gesichtspunkt des rechtmäßigen Alternativverhaltens fraglich erscheinen könnte, und die Revision zeigt nicht auf, dass das Berufungsgericht insoweit konkreten Vortrag des Beklagten, der nach allgemeinen Grundsätzen die Darlegungs-und Beweislast für den Einwand rechtmäßigen Alternativverhaltens trägt (vgl.
