En el presente artículo se exponen las virtudes y los resultados del proceso monitorio aplicado en otras latitudes con la finalidad de poner en evidencia que se trata de un proceso que, lejos de la discusión sobre su naturaleza jurídica, logra resolverlos conflictos sometidos a este en un tiempo prudencial. Luego, se analizan los procesos laborales de menor cuantía que se tramitan bajo la Ley n.º 29497. Se concluye que estos procesos pueden ser adaptados o sometidos al proceso monitorio, lo cual permitiría que su tramitación y resolución se efectúen en un plazo razonable, lográndose así la celeridad que pregona la nueva ley procesal del trabajo.
En el presente trabajo recogemos algunos alcances sobre las doctrinas procesales del garantismo procesal y activismo judicial, de los cuales extraemos sus postulados, características y manifestaciones, para luego analizar qué tipo de jueces laborales tenemos. Para dicho propósito, usaremos como metodología la revisión documental de los recientes análisis doctrinarios efectuados a una década de la promulgación de la Nueva Ley Procesal del Trabajo (NLPT en adelante), las «buenas prácticas» implementadas por los jueces laborales de nuestro país, el Protocolo de Actuación de Audiencias Laborales elaborado por el Equipo Técnico Institucional de Implementación de la Nueva Ley Procesal del Trabajo (ETII en adelante), el Protocolo para Audiencias Judiciales Virtuales y el Diagnóstico de Capacidades de Jueces que aplican la NLPT, a partir de los cuales, luego de efectuada la discusión pertinente, concluiremos que tenemos jueces laborales predominantemente activistas.
