<p>Opracowanie dotyczy zagadnienia wpływu zasad równości i sprawiedliwości społecznej na prawo emerytalne. Autor stwierdza, że równość w prawie emerytalnym jest pojmowana w sposób szczególny, co wynika z naturalnego dla prawa ubezpieczeń społecznych zróżnicowania praw i obowiązków w sferze podlegania ubezpieczeniom, rodzaju wykonywanej pracy czy też z uwagi na płeć. Prowadzi to do odstępowania od nakazu równego traktowania podmiotów równych (podobnych) na rzecz dyferencjacji uprawnień emerytalnych uzasadnianej m.in. zasadą solidarności. Z kolei kwestia sprawiedliwości społecznej wiąże się głównie z ustaleniem reguł partycypacji w środkach pochodzących ze wspólnie tworzonego funduszu. W tym zakresie, aby zapewnić sprawiedliwy podział świadczeń, niezbędne jest wzajemne uzupełnianie się zasad „według pracy” i „według potrzeb” w celu zachowania komplementarności obu formuł sprawiedliwości. Wymiar świadczeń, uwzględniając społeczny charakter systemu emerytalnego, nie może być całkowicie zależny od wcześniej wniesionego wkładu (składki), powinien być bowiem korygowany mechanizmem przesunięcia środków w ramach danej generacji (np. od bogatszych do uboższych czy od krócej żyjących do dłużej żyjących). </p>
Equality and solidarity are values which, in universal health insurance, take on the form of legal principles anchored both in the constitutional directive of equal access, irrespective of the materialsituation of the citizen, to health care benefits financed from public funds (Article 68, paragraph 2 of the Constitution of the Republic of Poland) and the statutory provision that health insurance isbased on the principle of equal treatment and social solidarity (Article 65, point 1 of the Act on health care benefits financed from public funds). The relationship between these two principles within the framework of universal health insurance is that many of the existing exceptions to equal treatment are justified by solidarity in bearing the costs of this insurance (the rule from the insured/regions richer to the insured/regions poorer) or in providing health care benefits (the rule from less severely ill to more severely ill). However, not all regulations in this area result from objective differences between the insured. Doubts are raised particularly by the differentiation of the health contribution interest rate among entrepreneurs, the financing of health insurance by farmers, or the accumulation of contribution burdens on persons who earning income from employment or non-agricultural activity.
Zarys koncepcji ryzyka socjalnego w polskim prawie ubezpieczeń społecznych stworzono przy wykorzystaniu amerykańskiego (ekonomicznego) podejścia do teorii ryzyka ubezpieczeniowego ujmującego to pojęcie w kategoriach niebezpieczeństwa postrzeganego jako przyczyna realnych zdarzeń. W konsekwencji istota ochrony ubezpieczeniowej sprowadza się do odczuwania komfortu psychicznego (poczucia bezpieczeństwa materialnego) zapewnionego przez sam fakt ubezpieczenia. Tym samym za świadczenie wzajemne z tytułu bezwarunkowo opłacanej składki uważa się przejęcie i ponoszenie ryzyka przez ubezpieczyciela, a nie ewentualne wypłacenie świadczenia ubezpieczeniowego. Mając to na uwadze, ryzyko socjalne należy rozpatrywać nie od strony zaspokojenia potrzeb, jakie ono niesie, gdy się ziści (teoria świadczenia pieniężnego), lecz w kontekście świadczenia ubezpieczeniowej gwarancji „na wypadek” zajścia określonych zdarzeń (teoria ponoszenia ryzyka).
THE FORCE OF RES IUDICATA IN AJUDICIAL PROCEEDING IN SOCIAL INSURANCE CASESIn social insurance cases there is no force of res iudicata in the event of re-establishment of aright to abenefit if the person concerned refers to new evidence or disclose circumstances that had existed before the date of issuing the previous decision, should the aforementioned evidence or circumstances affect such entitlement or its amount. It is aresult of adifferent — as opposed to resumption of judicial proceedings — regulation of this institution in social insurance law, characterised by less rigorous as compared to Polish Code of Civil Procedure understanding of grounds for resumption of appeal proceedings. In particular, the “disclosed circumstances” not necessarily need to be new unknown facts and resumption of appeal proceedings is not restricted by the necessity of proving that the party could not have used them in previous proceedings. The force of res iudicata exists only when the court — hearing the appeal against the challenged decision — decides that the conditions for are-establishment of aright to abenefit have not been met, as the new decision denial of the pension authority regards the same factual and legal basis that were covered by the previous verdict.
