En este estudio se analiza la relación entre la tenencia de títulos de propiedad (registrados) y los mercados inmobiliarios en aquellas zonas de la ciudad cuyo origen fue informal o ilegal. Al hacerlo se plantean cuestionamientos a los presupuestos internacionales y se encuentran paradojas en el funcionamiento del mercado de suelo popular. La metodología es cuantitativa y cualitativa. Las conclusiones muestran que en los asentamientos no consolidados la tenencia de un título de propiedad contribuye a conferir un mayor valor a los predios en relación con los que no están titulados. No obstante, el título de propiedad no necesariamente induce al predominio de los mercados inmobiliarios formales; más bien se mantienen las tendencias que apuntan a las transacciones informales en cuanto a alquileres, compras y ventasAbstractThis study analyzes the link between the ownership of property deeds (registered) and real estate markets in parts of the city whose origin was either informal or illegal. By doing so, it raises questions about international assumptions and finds paradoxes in the way the popular land market operates. The methodology used is both quantitative and qualitative. The conclusions show that in unconsolidated settlements, ownership of title deeds increases property value. Title deeds do not however, increase the predominance of formal property markets. On the contrary, the tendency to engage in informal transactions regarding rent and buying and selling continues to exist.
Este artículo busca entender como la acción de gobierno puede generar la informalidad urbana y sus consecuencias. Tomando como referencia el caso peruano, este artículo no busca abundar en información empírica, sino reflexionar acerca de la relación conceptual entre Estado e informalidad. Al respecto, conviene distinguir la informalidad laboral (definida por las condiciones de trabajo en relación a un marco jurídico vigente) de la informalidad urbana, referida al modo en que grupos sociales acceden al suelo, se proveen y gestionan servicios básicos y construyen su vivienda. En el Perú, entre 1990-2019, se ha desplegado un modelo de libre mercado que ha buscado promover la inversión privada y la empresa formal y, explícitamente, se ha planteado reducir la informalidad. Se considerarán cuatro aspectos: la política de vivienda y la política de titulación de la propiedad, ambos destinados a frenar la informalidad, la entrega de constancias o certificados de posesión municipal y, finalmente, el paso del predominio de invasiones al de mercados ilegales de tierras en el acceso al suelo. El artículo se ha basado en la revisión de información secundaria.
En este trabajo se presentan los resultados de una investigación que, apoyada básicamente en el análisis de los periódicos de la época, en entrevistas a líderes de colonias populares y en la consulta de la bibliogra/ía disponible, describe las características más relevantes de las luchas por la tierra, en zonas ejidales y comunales del área metropolitana de la ciudad de México, entre 1980 y 1984.Después de hacer referencia al contexto general dentro del que se dan estas luchas (particularmente cómo se ha producido el crecimiento urbano sobre tierras colectivas, y sobre todo en aquellas que fueron entregadas a los campesinos con la reforma agraria), el articulo se centra en el análisis de las contradicciones sociales producto de las ventas ilegales de esas tierras. Se hace referencia, a partir del análisis periodístico, a los sujetos movilizados en las luchas, a su relación con los objetivos de la movilización, y a las oposiciones generadas en cada uno de los casos estudiados, fisto permite al autor ojrecer una visión (para la zona y el periodo analizados} del número y tipo de luchas ocurridas, de las características de los protagonistas y de los motivos por los cuales se movilizan.El trabajo termina con una interpretación de estas luchas a la luz de una breve caracterización del sistema político mexicano, retomando al mismo tiempo algunos elementos conceptuales presentados por investigadores sociales que han teorizado sobre el tema de los movimientos sociales.Se concluye que, si bien los conflictos sociales analizados no han afectado el sistema de dominación en México, se han dado importantes luchas politizadas que alteraron los canales tradicionales de participación ciudadana.
