O conceito de abandono afetivo surgiu no início dos anos 2000, apesar de estar presente na sociedade muito antes de manifestar-se em decisões judiciais. Configura-se a partir do afastamento praticado por um genitor em relação ao seu filho. Ainda não existe legislação específica para o caso, ocasionando discussões doutrinárias e divergências nos Tribunais no que diz respeito à aplicação ou a não aplicação de indenização pecuniária a título de danos morais de um pai em favor de seu filho. Nesse sentido, surge a pergunta que norteia este estudo: quais são os fundamentos utilizados pelos doutrinadores que defendem a aplicação de indenização por danos morais ocasionados por abandono afetivo? O objetivo deste trabalho é analisar os fundamentos que favorecem a aplicação de uma indenização monetária para penalizar o dano à criança abandonada afetivamente. Realizou-se uma pesquisa bibliográfica por meio da leitura de livros, artigos, julgados e jurisprudências. Os principais resultados desse estudo apontam como a legislação brasileira evoluiu nas últimas décadas ao estabelecer princípios que igualam os deveres e direitos na sociedade conjugal e o reconhecimento da dignidade para todos, independentemente de sexo ou idade. Mostram também como o abandono afetivo prejudica o desenvolvimento saudável de uma criança, e como a aplicação de uma indenização pecuniária pode, em caráter pedagógico, ensinar a sociedade que condutas lesivas serão punidas e em caráter dissuasório, extinguir o sentimento de impunidade reprimindo comportamentos danosos. Conclui-se que essa punição monetária tem o propósito de conscientizar a sociedade, pois essa evolução gera um remédio, a longo prazo, para a construção de uma sociedade mais desenvolvida tendo em vista que crianças emocionalmente saudáveis se tornam adultos seguros, equilibrados e aptos para construir relações saudáveis.
