Pese al reconocimiento de la importancia emancipadora de la educación, subsiste un modelo sustentado en las promesas que legitimaron el privilegio epistemológico en el siglo XIX, que han reproducido estereotipos de subordinación y minimizado las responsabilidades que el saber trae consigo. Con fundamento en lo anterior, producto del proyecto “La clínica jurídica como estrategia de formación en el Programa de Derecho de la Unab”, avalado por esta institución en la convocatoria 2019-2020, y que se derivó de la intervención realizada por el autor en la Maestría en Educación en Derechos Humanos del Crefal; aquí se sistematiza una experiencia pedagógica con miras a redimensionar los desequilibrios existentes en la formación jurídica, buscando hacer del aprendizaje una actividad significativa, colaborativa, sensible y servicial.
En el ámbito jurídico colombiano, la Corte Constitucional se ha erigido como garante y protectora de la Constitución, asumiendo la prerrogativa de establecer límites al poder público y a los particulares. En este sentido, su discurso es la manifestación de una categoría, tanto jurídica como política, privilegiada. El discurso resultante de la hermenéutica constitucional ha desarrollado una enorme cantidad de temáticas, pero en relación con un sector tan cotidiano como vulnerable en el país: la población habitante de la calle, su jurisprudencia ha sido variable. A lo largo del presente artículo, producto de la investigación titulada: Representación constitucional del habitante de la calle: un estudio sobre el discurso de la Corte Constitucional colombiana en torno al concepto de habitante de la calle, financiada por la Universidad Autónoma de Bucaramanga, UNAB, se verificarán los significados o definiciones ofrecidos por la Corte Constitucional, entre 1992 y 2016, para evidenciar su tendencia y principales influencias.
La caricatura política es una herramienta lúdica de comunicación, diestra en hacer circular mensajes, por lo general, no subordinados al discurso de quienes detentan el poder o ejercen algún tipo de control estatal. De hecho, se trata de un recurso que incorpora información que rápidamente es capaz de sumarse a una conciencia común. Revela tensiones y juicios acerca de personajes, colectividades o acontecimientos, y a la postre, no solo advierte, sino que induce una mirada de la realidad. Su estudio, en este sentido, constituye una alternativa interesante de investigación, que privilegia la interpretación de signos en un tiempo y espacio determinados, para reconocer datos no siempre evidentes en otras fuentes de conocimiento. No obstante, suabordaje exige una comprensión amplia alrededor de su contexto y evolución. Este artículo, producto del proyecto titulado: “Imaginario político de las decisiones judiciales en torno a la reforma constitucional de 1991”, busca, precisamente, sistematizar los antecedentes y el estado del arte en la materia y evidenciar su valor artístico, informativo y científico.
La Marcha del Silencio, en repudio por el asesinato de Luis Carlos Galán Sarmiento, fue el preámbulo del Movimiento Estudiantil de la Séptima Papeleta. El sentimiento de inconformidad llegó a las aulas universitarias y en un corto periodo fueron planteados los principios de la revolución que daría paso a la convocatoria de una Asamble Constituyente. El presente trabajo examina cómo era visto y cómo fue recibido dicho movimiento social en la caricatura política de los dos diarios de mayor tradición y circulación en todo el territorio colombiano: El Espectador y El Tiempo, bajo la premisa de que es posible rescatar la realidad de un país en las páginas de sus periódicos.
