Sind Ostdeutsche eine Ethnie? Diese Frage hatte 2010 das Recht zu beantworten. Gegen die mit dem Vermerk "Minus-Ossi" erfolgte Ablehnung einer in der DDR aufgewachsenen Stellenbewerberin versuchte ihr Anwalt das Allgemeine Gleichbehandlungsgesetz (AGG) zu mobilisieren und die "ethnische Herkunft" ostsozialisierter Menschen nachzuweisen. Ohne Erfolg: Das Gericht befand, es gäbe zwar Ethnien, die "auf der manifestierbaren Unterschiedlichkeit der Menschen" gründeten, jedoch keine abgrenzbare "Ossi"-Ethnie, da BRD-und DDR-Bür-ger_innen eine "gemeinsame Kultur der letzten 250 Jahre" teilten. 2 Der Fall illustriert, dass Diskriminierungsmerkmale, wie ethnische Herkunft, Rasse, Behinderung oder Geschlecht 3 , Betroffene zwingen, sich in die etablierten Merkmalsgruppen einzuordnen. Gelingt das nicht, erhalten sie keinen Rechtsschutz. Andernfalls drohen ihnen die Bescheinigung einer essentiellen Differenz durch die Zuordnung zu einer natürlich erscheinenden Gruppe sowie Homogenisierung, weil Gemeinsamkeiten innerhalb der Kategorien überhöht und Unterscheidbarkeiten zwischen ihnen zu exklusiven Unterschieden gemacht werden. 4 Da Gruppenrechte Differenz und Ungleichheiten essentialisieren und kollektive Identitätskonzepte verfestigen, sind sie-so Susanne Baer-"keine Lösung, sondern ein zentrales Problem von Recht gegen Diskriminierung". 5 I. 1 Dieser Aufsatz ist aus einem gemeinsamen Panel der Autor_innen auf der Konferenz "Der Kampf ums Recht?" der deutschsprachigen Rechtssoziologie-Vereinigungen vom 1.-3.9.2011 an der Universität Wien hervorgegangen.
