Las garantías constitucionales del debido proceso son efectivos mecanismos de protección al ciudadano (servidor público) que se enfrenta al ejercicio de las potestades sancionadoras, en un procedimiento administrativo disciplinario. El objetivo del presente trabajo es analizar críticamente las garantías del debido proceso en los distintos regímenes jurídicos de procedimientos disciplinarios que se aplican para los servidores públicos, en relación al ejercicio de sus funciones. Para su cumplimiento se desarrolló un estudio descriptivo de tipo revisión documental, apoyado en los métodos de investigación exegético, análisis documental y hermenéutico, así como en la técnica de análisis de contenido. Como resultado se estableció que, a través de cada una de las fases de los procedimientos administrativos disciplinarios, que van desde la acusación al servidor público hasta la decisión de la autoridad pública que se materializa con un acto administrativo; los procedimientos están formal y materialmente diseñados para garantizar el debido proceso del servidor acusado. En su dimensión formal, existen minúsculas diferencias en cuanto a sus estructuras que no son trascendentes ni afectan las garantías del debido proceso; y, en su dimensión material todos deben observar la garantía de motivación y sus subprincipios.
La legislación ecuatoriana establece la figura del silencio administrativo positivo como regla general ante la ausencia de un pronunciamiento expreso por parte de las administraciones públicas en un término de treinta días. Sin embargo, no se determina con claridad cómo debe ser ejercitado el derecho de petición para generar actos presuntos estimatorios plenamente ejecutables ante la jurisdicción contenciosa administrativa. Este trabajo se ha realizado con el afán de definir los elementos indispensables en una petición y su capacidad de generar un acto presunto estimatorio, ejecutable ante la jurisdicción contencioso administrativa. Lo cual ha podido lograrse empleando métodos científicos como el método cualitativo, histórico lógico, e inductivo-deductivo, basándose en diversas fuentes bibliográficas de autores clásicos como modernos, así como normativa histórica y desarrollo jurisprudencial en materia Contencioso Administrativa.
La presente investigación descriptiva con enfoque cualitativo tiene por objetivo analizar la realidad de las mujeres artistas en el Ecuador y su derecho al trabajo en aras de fomentar el debate sobre la importancia de las artes, las problemáticas de las mujeres artistas y su acceso al trabajo digno y sostenido. Se emplearon los métodos científicos de investigación, a saber: histórico-lógico, exegético, revisión bibliográfica y análisis de contenido. Entre los hallazgos se significa que a pesar de la existencia de normas sobre la actividad artística no existen políticas públicas locales para las mujeres artistas. Es urgente la creación de estas políticas públicas para la generación de planes, programas y proyectos, así como la reactivación económica del sector, como parte del ejercicio del derecho al trabajo digno y sostenido como plantea la Constitución. Las mujeres artistas necesitan de la creación de un sistema parroquial, cantonal, provincial de cultura donde prime la inversión económica para fomentar la producción artística, la difusión masiva con enfoque de identidad pluricultural, los espacios tecnológicamente equipados y nuevos públicos, contexto donde puedan desarrollar su capacidad creativa, con una remuneración digna.
