El artículo pasa revista a la revalorización del federalismo americano a lo largo de las dos últimas décadas que ha llevado a cabo el Tribunal Supremo bajo la presidencia del juez Rehnquist. El Tribunal aboga por una interpretación restrictiva de los poderes del Congreso (cláusula de comercio interestatal, apartado 5 de la XIV Enmienda, y a través de la X Enmienda). Sin embargo, al mismo tiempo utiliza de forma amplia la doctrina de la primacía del derecho federal sobre el estatal. Aunque sea pronto para advertirlo, parece que el nuevo Tribunal Roberts sigue sustancialmente la doctrina precedente y que la presidencia Obama apunte a un «federalismo progresivo» en el que prime la cooperación entre las autoridades centrales y estatales.
En este trabajo se lleva a cabo un acercamiento a la doctrina de la Comisión de Venecia sobre la independencia judicial en el contexto de la preservación del Estado de Derecho, la separación de poderes y la garantía de los derechos. En particular, nos hemos centrado en la composición y elección del Consejo Judicial, como solución por la que aboga la Comisión con carácter general, sin perjuicio de las particularidades que existen en las viejas democracias consolidadas. La Comisión de Venecia exige una composición plural, con una mayoría elegida por los propios jueces y el resto por el Parlamento, con mayorías cualificadas. De este modo se evita tanto el corporativismo como la politización de la institución.
